Hello, i'm new in this site and i need some advice... I arrived in US last Nov 18 with a K1 visa, i got married Dec 17 and my 90th day here in US is on Feb 15.

My husband didn't applied yet for my SS number and changing of my status due to financial issue... What will happen to me after Feb 15?

U can Get a SSN , it's Free , and about filling for ur AOS it can wait even after 90days from ur entry because the 90 days it's TO GET MARRIED not to fill for AOS , (it's better to get u a SSN and state ID) then when ever he made the 1070 u can fill for ur AOS , wish u a gd luck

If you don't file to adjust your status after Feb 15, you become a visa overstay. There are several consequences that you should be aware of;

Even with a SSN, you will not be able to work because you will have no legal status in the US.

In addition to the fee to adjust your status with the I-485, you will need to pay the fee for the I-130 (another $400 or so). If you file before Feb 15 to adjust, you don't need to file the I-130.

If ICE picks you up, you can be detained until your US citizen spouse files the I-130 and I-485.

If you overstay more than 180 days and you leave the US, you will be ban for 3 years from returning to the US. If you overstay more than a year and you leave the US, you will be ban for 10 years. (The overstay will be ignored or forgiven when you get a green card.)

The bolded portions are WRONG! The I-130 is only required if they marry after 90 days, or they file AOS after 2 years of marriage.

If ICE picks the OP up prior to filing AOS (and sometimes even AFTER filing AOS), they will be put in immigration detention. They are sometimes able to post bail. They go before an immigration judge who orders them to AOS asap. They will NOT be detained until they file.

As to the SSN, they can't work without an EAD, either prior to the I-94 expiring or after so that's a moot point.
