I am in line to be scheduled for an interview for citizenship based on marriage. However, my wife and I are not doing so well emotionally, we just feel as we are growing apart day after day. We still live in the same house together and share all the bills and expenses. Now it got to the point where I feel like moving out and living by my own. My question is since I will have my interview within the next month or so. is there a way I can cancel my application and just apply based on the 5 year residency when its time? will marital problems affect the outcome of the interview? Will that raise any red flags? We both entered into this marriage in a good faith, it just seem very difficult to communicate and solve the problems and I feel like I am ready to move on.

Please advice!!

If you are now at a stage where it is certain you will part ways I would withdraw the application since otherwise you will be not telling the truth at the interview, and that could be severe later on. The rule is: Never lie to the USCIS. Call the USCIS 1-800 line or schedule an infopass at your local USCIS office and ask what needs to be done to withdraw the application.

This will not affect your current status and you will be able to apply based on 5 year residency when the time comes.

Appreciate your reply.

Is this worth having an immigration lawyer?

Nope. I think you will just need to write a letter stating that you withdraw your application. Just call USCIS and ask what the wording needs to be and where to send it or do an infopass appointment at the local USCIS office. Should be fairly easy.

It's wonderful that you feel being honest is important. As noted above if you explain to them you wish to withdraw because it would be dishonest to base it on marriage, I'm sure they'll explain what is required.
