Timeline

Notice of Acticity ( most people hope it is a notice of approval ) Calfornia will usually declare it expired. They have played the same game for year. They tell you they have 120 days to review it and their review finds the K1 expired. You can refile a K1 now or get married and do a CR1. The K1 has the advantage of not needing another trip ( assuming it has been less than 2 years since you were together) and the filing will force the review of the K1 that you assume as expired as an excuse to file the second K1 ( which basically forces a NOID or reaffirmation of the old one ) A CR1 you are on new grounds and the old K1 may not be examined.

This will not be over quickly. You will not enjoy this.
