Hey guys! I want to make sure I have this correct. My POE day was August 3rd..I came on a K1 visa from Canada. We were married October 15th and my I-94 expired October 31st. They received our AOS paperwork on October 28th. I got my EAD and Advance parole about one week ago and am planning a trip back home for two weeks before getting back to work. I have read that if you are here unlawfully for 180 days it COULD trigger a 3 year ban when coming back into the States. So as of October 31st did I start accumulating out of status days? and if so is there a chance of a ban if I go home for a visit? I know they can always deny me and I'll get inspected like any other time I've crossed but I've already been denied entry once in the past because I didn't have enough strong ties to Canada and they thought I was trying to immigrate here the wrong way. Don't want to push my luck. If there is a chance at all this might cause a problem, I'll just wait.

When they received your AOS paperwork, you entered into a NEW period of authorized stay. Since that happened before your K-1 I-94 expired, you have zero overstay days. Bon voyage!

Agree with Harpa. Moving from AOS Process to the Travel forum. Welcome to VJ. :)

When travelling with Advance Parole you will give them both sets of documents. You will be sent to Secondary to be processed. Once you have your greencard you will no longer go through Secondary. Have a great trip.

I would only worry about missing your interview letter or date IF you have an interview should you be out of the country when it arrives or is scheduled. As the others have stated, you are good to go.

Awesome! Thanks for the quick replies! My husband will be here to check the mail, so if need be I'll just have to jump on a flight back for the interview. It's crazy how there is so much stress and waiting to get here and once you can relax a bit you get homesick! haha. Thanks again!
