Father's DOB in I130 and DS230

Hello.

My wife’s father’s actual bday is on Aug 01, xxxx so when I filed I-130, I put the date that was provided to me by her parents. However, in his Passport, he has a different date for his date of birth (in india to get into school early, they put few months earlier for their DOB, i.e. May 01, xxxx). All his other id’s (voting id) have his actual bday (aug 01, 1960). Now when my wife is filling out the DS230, does she put the date provided in i130 (i.e. Aug 1) or the date that is in her father’s passport? If we put the date in the passport, which I’m sure takes precedence, wouldn’t I have issues now b/c data in the I-130 doesn’t match with DS230 data (two different dates).

I would definitely call and explain the situation. You want to get this clarified as quickly as possible before you are potentially slapped with misrepresentation.

You may have to have him get his passport renewed with the correct date.

Does your father in law have a birth certificate?
