Switching from K-1 to K-3

My fiance and I applied for the K-1 visa about a month ago. However, the circumstances have changed a bit as his father has passed away and we were thinking of getting married in Jordan (his home country) instead of marrying in the US. Is there anything we can do to change the visa application or would we just have to start a new one? Also, what are the differences between different spousal visas? Does one allow him to work immediately and one not?

Thanks so much for any input you might have from your own experiences!

I am sorry for you losing your father in law.

You will lose money and have to withdraw the K1 after you marry and start over.

CR-1 and K3 are spouse visas.

K3 will not allow him to work for 3-6 months after his arrival. It costs more and can take longr than CR1. It was developed years ago when CR1 were taking 2-3 years to complete. Now cr1 are much quicker so the K3 is becoming not used so much.

CR1 allows him to work. within 2 weeks he will get his social security number and greencard. It is cheaper (nothing is cheap in immigration) and it is usually quicker 8-12 months from sending off petition.

Good Luck
