I came to the US on my tourist visa to visit my husband on Dec 23. With all intentions of going back home we found out that my husband has to do major surgery and will be out of commission for a while. I contacted USCIS and told them of the situation and was told to send medical records from my husbands doctor. I did this and was granted permission to AOS while in the US. I sent in the I485 package but now I'm freaking out because I'm not sure of the timeline for the whole procedure now. Is it 5-6 months for the I130 and then another 5-6 months for the I485 so it now adds up to a year. I was told I have to wait for the whole thing to go through before I can travel back home. I am totally freaking out because I have a business home to take care of

The pending I-130 will be matched up with the I-485 and continue processing together. The I-485 takes around 3-5 months, so everything should be completed by then. It is true that you cannot travel home without abandoning your I-485.

Edit: NY is fairly slow right now, so it may be longer (your profile shows Brooklyn). However, you can get Advance Parole which is temporary travel permission. That takes about 3 months to be approved. Did you apply for AP?

That's what I was told. If I travel I'll be abandoning my I485

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You can apply for advanced parole (I-131) if you haven't already. This will take 2-3 months to be approved and is free with AOS. Then you can travel.

If you leave without AP or the green card you will have abandoned your AOS and have to file for a CR-1. You won't be able to return to the US until it is approved which is about 7-9 months.

10.15.2010 - RFE received: need 2 additional photos for AP.

10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
