I have been filling out the forms and run into a lot of questions. Please help me understand?

I-485

  • Part 1- C/o (In care of) <--- What is this? How do I answer this?
  • Part 3A- Can someone explain?
  • Part 3B "Applying with you?" <--- Should I write my married name?

I-131

  • Part 1- #3 What is "class of admission"?
  • Do I need to fill out part 3 at all?

I-765

  • #10 What is I-94 Number?
  • #12-#13- Are they talking about P.O.E?
  • #15- Should I write K-1?
  • Where is part 2??

I-864

  • Part 1- Can I check more than one box? If not, which one should I choose?
  • Part 4- #15?
  • All of part 5...please explain
  • Part 6- #24e- Should I list Ice (husband) in #24b?
  • Part 7- Should I do #26?

Also, obviously we passed the interview at BKK, but for the I-864 form, if my tax returns from 2011, 2010, and 2009 look bad, what should I do? I've only had my new good job since this past May, and I was a full time student before. I do not want to do a co-sponsor. My parents have helped enough.

ALSO, do the new 2012 poverty guidelines apply now?

Sent AOS: 4/21/12
NOA1: 4/30/12
RFE: 5/14/12
Biometrics App.: 5/21/12
Sent RFE Response: 5/31/12
Interview: 7/24/12
Approval: 10/12/12

Currently.... they have issued Ice the incorrect GC and we have tried 4 times to fix it. First time they had us send it to the incorrect address. Second time they said we used an expired form, which was the form they gave us. Third time was "oh sorry we lost the last page, can you send it again?." Fourth time is the gov is shut down. Will this ever be corrected in time for Ice to get the permanent GC? Stay tuned to find out. T_T

You might want to read the guides and other information as I found your questions are answered in the instructions of the forms. I have included respones below to help others as well. I just hope you are more prepared for ROC as you need to begin that process NOW and you really need to know what documents and information you need to be collecting NOW.

I-485

  • Part 1- C/o (In care of) <--- What is this? How do I answer this? This is used only if you are not the primary person living at this address
  • Part 3A- Can someone explain? This is the information of the perosn who is completin gth for and requesting the AOS. I.e. the person that just came on the K-1 Visa
  • Part 3B "Applying with you?" <--- Should I write my married name? Rather self explanatory. List your current SPOUSE and any children that you have. Do they need to apply for AOS? A USC does not so they are not applying with you. Were any children issued a K-2 visa and travelled with you then they will be applying with you.

I-131

  • Part 1- #3 What is "class of admission"? K-1
  • Do I need to fill out part 3 at all? This is a government form--nothing can be left blank. Answer to the best of your ability. You can put in any date--we put in as soon as possible and 3 weeks for the length of stay.

I-765

  • #10 What is I-94 Number? This is the number of the white I-94 form you received when you entered the USA
  • #12-#13- Are they talking about P.O.E? Yes, when did you last enter the USA?
  • #15- Should I write K-1? Yes and for #14 as well
  • Where is part 2?? What? you want the form to be longer :lol: . It is one page long.

I-864

  • Part 1- Can I check more than one box? If not, which one should I choose? If they apply. Typically you check box "a"
  • Part 4- #15? Where do you live? My bet as this is for a K-1 and after getting married and filing for AOS the naswer is the USA
  • All of part 5...please explain HOw many people are in your family that you are fiancially responsible for. There is at a minimum your and your spouse. Any children by the two of you/ Any children from a previous marriage? Those must be counted as well. This is for figuring the number of people to use for determining the income level you must be above in order to support them. That level is 125%.
  • Part 6- #24e- Should I list Ice (husband) in #24b? This is the income from the USC only since the K-1 visahold cannot legally work until the GC or EAD is approved and in their hot little hands.
  • Part 7- Should I do #26? Depends on if you are using assets from another person. If you qualify based on income alone there is not need to list assets. I did not list any assets.

The 2012 guidelines will not come out and be in effect until March/April.
