1040 vs IRS Transcripts

i-134 instructions actually state copy of last years tax return, does not ask for transcripts. It doesn't say 3 years worth, just one year. And it only says tax returns are needed for self-employed.

That being said the consulate can be as creative as they want....

I just read of a interview in Manila where they requested a copy of the petitioner's 1040.

Someone just posted this on my other thread in the Philippine forum.

"I sent transcripts for the last two years and there were no problems"

I am now beginning to believe they will allow IRS transcripts as long as you are not borderline income.

NoneYa: There are TWO different transcripts available from the IRS

The two types from the IRS website:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income.

So in doubt just order BOTH types from the missing tax year. That way you have all the info required.

Someone posted that the IRS transcripts are not acceptable. They want the 1040 at the Embassy.

Even though I have the IRS transcripts (showing I paid the IRS) do I have to have the 1040 ? I am a technology manager so I am no where near poverty. I am missing 2010's 1040 but I will be sending 2011 1040 to her as I will have time to file before her interview.

I sent last year transcript only. Visa granted today.

So, you need to submit signed I-864 and IRS transcript for last year.

Here's a thought genious.

Send copy of previous year's tax return with associated W2/1099/etc (OR) previous year's IRS transcript (AND) proof of current employment and income.

Like you are supposed to do.

duh

How the hell does this 3-yr thing keep coming up? They did away with that before 2007 when we filed

i don't get it.

Like everything in this process, I don't focus on single battles but "war" outcome; that is: I'll follow whatever rules they want (and will not even try to find the logic or argue -I consider both lost time and effort-), and targetting the end result of a visa in hand, GC in hand, etc; so I can go on my way.

If they want 1040s, give them 1040's; notarized? no problem; printed in letter size, not A4? no problem; the goal is to take any possible excuse for questions away.

Good luck.

The 3-year might be a spill from the I-864. However, the 864 does not require 3 years either, it is optional to send the transcripts for 3 years, but still need to indicate last 3 years of income.

As we all know, each Embassy can tweak the rules as they please.

The name of the game here is to follow whatever rules are in front of you. Arguing and/or fighting it is usually leading nowhere except delays.

Some of the responses are are just laughable.

Some people cannot seem too give their advice without being snarky know-it-alls.

OP: Glad you were able to track down your 1040s from previous years. Submit what you've got, sounds good. Though you would've been fine with what you what you had.

On a tangent (to noone in particular): I would think that the transcripts would be preferable, as they show proof of the IRS receiving your returns. Any Joe can print out a 1040 form from turbo tax without actually filing the returns for that year, that's why if you turn in your 1040 copy they also want a copy of the W2, to verify the information. Just a thought.

You would think so. It appears either is acceptable for the I-864, but somehow they do list only the 1040 for the I-134:

e. To substantiate the information regarding income and resources, the sponsor should attach to the affidavit a copy of the latest Federal income tax return filed prior to the signing of the Form I-134, including all supporting schedules.

Hi everyone,

Regarding tax returns, is there a requirement that they be physically signed? I have pdf copies of my tax returns as prepared by a tax software that I used. However, given that I e-filed my returns, they do not show my signature on them. Would such copies be acceptable if corroborated with respective W2 forms?

Thanks,

Loulou
