I 134 - tax papers????

So here is the thing, we received our NOA2 and I was wondering if my faince(petitioner) needs a co sponsor . Because she started this job in September 2009 , prior to that she was studying, she makes nearly 40k a year. So it could be 2010, 2011 tax papers.

So what do you guys say. Do we need a co-sponsor?

The petitioner must make above the US poverty line.

2011 HHS Poverty Guidelines

125% of Poverty Line Must Equal: $18,387

The petitioner makes enough at $40,000. No co-sponsor is needed. Just have her provided the 2009, 2010, 2011 W-2 and 1040 forms filed. 2011 1040 she will not have as of yet but still put the 2011 W-2 with the 2009, 2010 W-2's and 1040's filed.

They go by annual income, she makes enough. Attach the most recent year tax return.

What still bugs me is do they want the gross income or the net income since I am self-employed??

Say if I make about $28,000.00 and I spend $8,000.00 to operate my business for that year. Then I really just make $20,000.00. Which one is it for 2 people.

It's the net business income from your Schedule C less one-half of the self-employment tax you paid as shown on your 1040. You can also include any other wages you reported on the 1040.

They want YOUR gross income, not the business. Line 22 of the personal 1040. They do not care about your business.

If you are writing off the revenue of the business as expenses, costs and depreciation you avoid paying self employment tax (you know this) but you also eliminate your personal income. That $8000 is not available for the family because it is business expense, NOT income.

Line 22! Remember, Line 22

Oh okay.....:D, get it now. Thanks. I'll cross my fingers and hope when I file my tax, I am still standing at or above the poverty line for 2 people.
