Hi there,

My husband is Canadian and working in Bermuda. I'm a US born citizen living in the US. He has been approved to move here but was also offered an extension on his job there (with some major added benefits that we hate to lose!)...

Does anyone have any idea how we can make this happen? He DOES want to come to the US and will, but we would like to postpone the move until late 2013. He would like to still be able to visit the US as well. His employer will be sending him away for various certifications in his field so he will NEED to be able to enter the US during this time.

If anyone has info on this it would be greatly appreciated. Personal advice or a website... anything!

Does the have the visa in hand? He'll have to speak to the US consulate about this. Clearly he has immigrant intent

Did he get a CR-1 or a K3 visa? Has it already been issued? How much vacation could he take?

If the visa has not been issued, delay as much as you can by taking your time sending back documents, asking for a delayed interview etc.

If his visa has already been issued, and it is a CR-1, then what I'd suggest is immigrate at the latest possible moment- so if his visa was issued this week, he could move early July. Spend as long as he can here (on vacation from work) and establish residency by getting bills in his name, starting a joint bank account, going on the lease with you etc. Then go back to work abroad, come back regularly to see you and maintain residency, and move over permanently in late 2013. It's somewhat tricky, as he'll be out of the country longer than a year, but if he enters the USA regularly and then stays in the USA from late 2013 for quite a while, he can probably do this.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think it's the CR-1. Isn't the K3 for fiances? He doesn't have it in hand, they said he needs to turn over his "stuff" to immigration when he flies in to the US. We tried to get all that stuff (joint bank acc., etc) but it's hard to do without his SSN!

Thanks for the input, that's kind of what we were thinking... that will be our next step then!

K-3 is for spouses. The K1 is for fiances

Im confused. He doesn't have the visa in his passport? Has he had the Cr1 interview?

If he had his interview and got the big brown envelope, he also got a visa in his passport. If not, there is a problem!
