If your spouse claims to having extra-marital affairs, doesn't make a damn bit of difference in a court of law with no-fault divorce laws. Just say you have irreconcilable differences.

Then they ask you what you have left, one can of beans, well she gets half of it.

Do have an option with the USCIS, just wait another couple of years.

Many different aspects to a marriage, sounds like yours is lacking the most intimate part, huge age difference? Well, none of my business. Use to be a very strong Catholic, that bit about no sex before marriage is BS if you are not even sexually compatible, a hell of a time to find out after you are married. Ha, even encouraged my daughters to live with the guys of their choice, didn't want to know about the rest, still a dad, but at the same time, didn't want them sampling, that isn't good either.

With that philosophy, rewarded with many great grandkids. Really, that is the only thing I will be leaving behind.

Wife and I managed to stick it out for two full years, the second was imposed by the USCIS, and as my wife put it, with complications, before we got married, but both of us as a team were able to work that out. But was kind of humiliating having young idiot USCIS kids telling us what we could or could not do.

You can have had sex with 12 monkeys and that's not a reason to declare the naturalization void.

I tell you what would qualify as material misrepresentation for this purpose: if you had been separated from your husband at the time you filed for naturalization, meaning if you did not live together anymore and were about to file for divorce, and had followed through with this plan now. If you were naturalized now, and divorce based on this previous-to-naturalization separation, you'd be running a high risk of losing it all.

Thanks for the reply everyone and also Bob! This is such a great little online community, really feeling the love. So FYI My husband and I never stopped living together. We never even stopped sleeping with each other. I was talking to the ex on and via email and sometimes on the phone for a few months. And I have known him as a family friend for many years. For the longest time nothing physical happened between us, he was living far away in another state. It only got physical for a 3 week period and then my conscience got the better of me and I ended it. I guess the bad thing was that I got his hopes up, made him think we could have a life together. It was wrong and that's why I never completed banished him from sending me emails. I still wanted to be kind and not make him feel used or foolish. But I guess now that he has become vicious I should just block him like everyone has suggested.

As for Denaturalization, I am worried that he will say we had an affair and he has emails to prove affections were real. I have emails to prove it ended before I applied for Naturalization, but still I don't need the headaches. I don't believe there was any material misrepresentation because "did you have an affair" was never asked during the interview. But maybe they could say I have bad moral character? What do you think? I live in a state where adultery is NOT a crime.

I am already a Naturalized Citizen. Waiting a few more years is not an option. The man I cheated with is threatening to get me in trouble with ICE for the affair - which ended before I applied for Naturalization. As for our sex life, now it's never been better. We are very compatible sexually. We just hit a snag after he gained a bunch of weight. Thankfully we have both adopted more healthy lifestyles and he's back to his old self. It's amazing what a little exercise can do! I think in general we are both working more as a team now. Which was something that we weren't doing before. It took a conscious effort and hard work but now it's second nature and doesn't even feel like we are even trying.

Bad moral character is a requirement for nearly every American politician. It's also the invisible force of capitalism, fueled by greed. Nothing un-American here, nothing to look down to. We're talking about the core of Americalism! I think you need to take your mind off of this. There's nothing your ex can do to undo what you have become, presumably.

Do you think there's a possibility I could be denaturalized?

No.

However there is a good possibility you could become divorced. Especially when the "ex" affair keeps trying to make trouble. But then you knew you were jeaporizing your future and that of your future children when you had an affair so no big deal.
