Hi guys. First of all, I would like to say that I am happily married to my husband. However, I was just wondering how it works to divorce a spouse whom you marry overseas. Do you have to go back to your spouse's country to the very same court to apply for divorce, or can you just file it within the US? Also, if you file within the US are you still legally married in the other country? Further complicating things, some other countries have divorce rules... for example, I had read that in India under the religious act that my husband and I married under, we aren't allowed to divorce for 1 year after marriage.

As stated earlier, my marriage is not in trouble, but I simply wanted to have the info. Thanks!

I think you would divorce in the country and state you both live in. USA easy to get divorced you just pay money to your spouse.

In Arizona its hot hot hot.

You can divorce in the US and be legally able to marry in the US.

Usually divorce is valid everywhere but some countries have other requirements. For example the Philippines.

This, I presume.

Late January 2012: I-130 petition completed but ON HOLD. Husband's mom has come down with debilitating illness, and he told me not to file petition at this time as he needs to stay there and take care of her... whether it takes a year or longer for her to recover. He says he loves me, but I don't know what will happen to our marriage now. I can't go there either to be with him, as I still have 2.5 years left of being a full-time student (and no more extended breaks). I'm feeling numb.
