Of course I can give her a I-134 if financial statement is not good. Read point 2. Thats the whole point of I-134. I am sponsoring her trip right from air ticket to her stay here.

She has to take her own financial documents and proof of strong ties eg. gainful employment, ownership of assets, immediate family still resident in the home country, membership in organisations, her bank statements etc. Things that show that she would most likely return if granted a tourist visa.

You don't need to give her your financials because she has to qualify on her own. The letter of invitation is not really necessary. They will ask her who she will stay with and who will be purchasing her ticket on the application.

I understand what your question is, what are the chances of your wife getting the B1/B2 visa? In order for her to get the visa, she needs to prove to the CO that she intends to return back to her home country. The burden of proving strong ties to her country rests on her shoulders, not yours! You can send the sponsorship papers and I-134, but she needs to convince the CO that she has a job, maybe a lease agreement, medical insurance, maybe some bills, that force her return.

I have been through the Customs a lot of times on a B1/B2 and have been in Secondary once when I was engaged to my fiancee. I had all the relevant paperwork and they let me in right away. So please ask her to take some papers which signify her return to her home country.

Also, all the respected members on here have been helping each other out since a long time. They are taking time out from their busy schedules just to help you so please refrain yourself from treating them like they have to serve you. Your posts are rather demanding than being requestful.

I have been here long enough to understand how frustrated people can be to get their loved ones with them and I understand your state of mind, since I once, applied for a B1/B2 as well.

By Law, and further additions to INA,

all folk applying for a tourist visa are automatically assumed to have immigration intent. All Visa Officers, thusly, make presumption that the Visa Applicant has immigrant intent back at the visa interview.

It is up to the Visa Applicant to prove up, to the Visa Officer's satisfaction, that the immigrant intent is false,

via showing strong ties to the Visa Applicant's home country.

This is covered in many Tourist Visa pages on many US Embassy WebSites.

IMO, she will have a hard time proving up this lack of immigrant intent, as HER HUSBAND is in the USA.

Realistically - the true answer is - WHO KNOWS? If she brings in the proof she needs, and is able to convince the Visa Officer that she has no immigrant intent - then it's possible.

Her elderly parents and my elderly parents can manage with or without her.. Thats not the point. I cannot file an I-130 ten minutes after she comes here..coz I have my own reasons not to file for her as of now. And she does not have to change her status to F1 coz she already is a masters degree holder and a qualified teacher back home. The only reason I am doing this is because i want her to stay here with me for sometime and then leave. Period.

yet many people do 'change their minds' moments after the landing touches the runway....and many seek a questionable F1 COS no matter what other education they have....and as for not being able and/or willing to file an I -130....huh? Yet it is sooooooo important she comes to visit for several months? Sorry, but that makes no sense. What part of the story are we missing????

I repeat....'sponsorship' does not exist as any requirement for tourist visa applicants....and in spite of her masters degree, etc, she lacks the ability to finance her own trip?

I got denied entry due to lack of ties to Canada. The CO said that my ties to my husband were greater than any ties to Canada - we had not filed the I-130 yet

Don't fool yourself, having a USC husband works against her. To combat that, she needs strong ties to her home country

Well, the people you should thank are all those previous spouses of LPRs who made all sorts of promises about why they would return....but didn't. I read something a couple of years ago regarding tourist visas and spouses of LPRs...the abuse rate was so high that some of our embassies almost had a policy stating they would not issue tourist visas to this group because of the high rate of non-compliance.

Like so many things in life, the people who have abused a certain privilege make it ten times tougher for those few who might be bona fide.
