See bold above. If they divorce and marry US Citizens they get the privileges of ignoring intent, that spouses of US Citizens get. As parents of US Citizens, their intent upon entry matters more. I think the divorce and remarry comment was tongue in cheek but nevertheless accurate.

not really, it doesn't matter more than a spouse intending to immigrate, I have seen tons of parents that have gotten their GCs even if they entered on a tourist visa. they didn't divorce their spouses.

many have said here not to do that for spouses the same as parents. overstay is forgiven and parents have the same rights because they are immediate relatives just as a spouse of a USC.

divorcing their spouses to marry USC for a GC that is really considered a fraud, not only intent.
