K2 Social Security requirememts

Timeline

First of all I would like to thank the all VJ community for the support and guidance. My family has finally joined me this past weekend. I have 2 years old daughter with my fiancee who came to the US through a K2 visa because at the time she was born I wasn't a US citizen yet.

According to the Social Security instructions a K2 visa holder can only apply for a social security after applying for an employment authorization card. Is this true? does it really make sense to apply for EAD for a 2 years old?

Can someone please tell me if there is a way for me to get her a social security without wasting time and money with the EAD process. I would like to add her to my health insurance as quickly as possible.

She doesn't need a social to get on your health insurance. EAD is free when filed with AOS.

Hmm it's good to know that EAD application is free when filed with AOS. I still don't understand why a 2 years old can apply for EAD. She can't work anyways. Is that the only option to get her a SSN or does she have other options as a US citizen child?

It is true and it does not make sense to apply for an EAD but you WILL apply for a green card and she can then get a SS number. You will have to get her a green card, do it then.

The EAD is just a temporary work document that you can usually get before you get a green card that allows work. The child will not need it. FYI when you file for the green cards it costs no more to file for the EAD.

GREEN CARD!!!!!!!!!!!!! Everyone, even children, must file for AOS and get a green card, THEN get the SS number for her.

In the meantime you can file your taxes and claim her as a dependent but you will need to get a letter from the local SS office stating she is not currently eligible for an SS number, write "pending" in the space on the 1040 for her SSN and file a paper return. Attach a copy of the letter from the SS office.

Also, you should not need the SSN for insurance, I did not for our sons, but you can attach a copy of the SS letter if needed.

File for the adjustment of status as soon as you've married. You don't have to apply for the EAD, if you don't want to, although there's no extra cost if you do. The only advantage it will provide for your daughter is it might allow her to get an SSN sooner, but many people receive the EAD about the same time as they receive the green card, and some don't receive it until after they receive the green card.

Talk to your HR department about medical insurance coverage. There is no legal requirement that a person have an SSN in order to get medical insurance. This is often a bureaucratic requirement of either a company HR department or an insurance company, and there is often a way to get around it.

Your daughter will become a US citizen as soon as her adjustment of status is approved. You should consider either getting her a US passport and/or certificate of citizenship after her adjustment of status has been approved.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
