Hello, I have a question in regards to the I-129F for K3. Before I got married to my wife I submitted the I-129F for Fiance and it got approved. During the process we got married; so when the packet made it the embassy in El Salvador we didn't continue the process. Now I have submitted the I-130 and recieved the NOA1 and I am about to send the I-129F for K3 Visa. Will there be any issues since I submitted a petition before? It is the for the same person but now it is for Wife. Will be previous count as it was approved or I have to wait for a new approval?

Forget about the I-129F for K-3. Stay with just the I-130 and CR-1 rout.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Both processes take the same time, 8-10 months usually, and the CR-1 leads to an automatic greencard upon immigration, meaning she can work, travel etc. Filing the I-129F can actually slow things down, as they will pull your I-130 out of line to put it together with the I-129F. PLus, usually the K3 path is administratively closed at NVC stage.

Inky is right, stay with the CR-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Doesn't the I-130 process take about a year? Once the I-130 gets approved she has to wait to get the green card.

I don't think you are understanding the process.

Once the I-130 is approved to the point she gets the visa in her passport, she moves to the USA and gets the green card after entering the USA.

She could be moved and living in the USA in around 8 months if you stay with the I-130 petition.

K-3 and K-1 have mostly the same limitations, albeit the duration of stay on USA on the I-94 is different.
