Newbie here so please be patient with me!

My situation: Several years ago I lived in the US and successfully adjusted status to temporary Resident with my Ex-husband. My marriage ended and I left the US without notifying anyone and returned to my country not thinking that I would ever need to go back. I met my husband while living in Australia (he is a US citizen and an Australian PR - just done! yay!). We have a daughter who is an Australia Citizen and a US Citizen. We haven't been back yet because we aren't sure of my situation there. Would our best option be the CR1? Any guidance is appreciated. I can pick things up quickly.

We would like to finish my Medical degree here first (so another year) and then move back there to be close to his elderly parents and they can see their only grandchild (my parents are 25years younger!) and we will then try our daughter in elementary school there.

Since you and your husband are married, when the time comes for you to move to the US, the CR-1 will be your only option. If you and your husband have been married for two or more years, then you are eligible for an IR-1 visa. The difference between CR and IR is if you enter on an IR-1 visa, you are given a green card that is valid for 10 years, no need to remove conditions. Whereas entry on a CR-1 visa would result in the issuance of a green card valid for two years and the requirement to file to remove conditions within 90 days before the conditional green card expires.

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I am in the same boat as you (more or less) left America with my wife (the USC) for New Zealand (my home country) I was on a IR-1 and had lived in the States for 3 years; we thought we would never go back to live in America so we didnt file the paperwork letting them know I was leaving so I 'abandoned' my GC.

Found out on day 1 after arriving back in New Zealand that it was a huge mistake coming back to a tiny island nation so isolated from the rest of the world BUT we decided to just stick it out in NZ but 3 years later this country is unbearable so we are making moves to be back in USA in a year so filing the paperwork now.

We have a 1 year old child now and a big part of moving back to USA is the schooling system in New Zealand is rubbish compared to America.
