Hello All!

So I am seeking advice for a friend that is in the process of doing a K1-Fiance Visa. She is still in the inital USCIS stage so that is why I am trying to verify what she needs to do in preparing for the Naija Consulate.

I know from personal experience that she will need proof that the relationship is genuine. I also know that typically evidence consists of phone records, photos taken together and with family and friends while visiting in Nigeria and messenger chat logs. This is my question... What can a person do to stregthen their case if they have phone records & chat logs but no photos as they have not met face to face yet?

The reason I ask is cos I KNOW that Nigeria is one hard Consulate to go through and I want to help prepare her as best I can considering she is already got "A Strike" as I would say against her for never visiting him in his home country yet.

ANY advice or guidance is greatly appreciated... Thank you in advance :)

I maybe wrong but I thought I read somewhere that you have to meet at least once in 2 years.

They better start making plans to see each other and start gathering proof of bone fide relationship, I don't see it going very far without strong evidence.

As I've read in VJ, Nigeria is one of the high fraud Countries, and she may be given a very hard time through this process.

If they havent MeT face to face.then they are not qualified for either fiancee or spouse visa.

The major requirement ils to have met at least once in the past one year.

If they cant meet in Nigeria,they can choose another country of their choice.without meeting,sorry petition wont be approved,talkless of getting to lagos consulate

They can file an I-129F petition without meeting withing the last 2 years under 2 conditions

1: The requirement to meet your fiance'(e) in person would violate strict and long-established customs of you or your fiance'(e)'s foreign culture or social practice. OR

2: It is established that the requirement to personally meet your fiance'(e) would result in extreme hardship to you.

Hmmm... thank you but now wondering HOW they can prove one of the above circumstances OR if they would even be REQUIRED to prove this?

it being established is interpreted by me as the petitioner establishing with USCIS the extreme hardship that would result from meeting the foreign fiance'(e). Proving to them or explaining to them the situation as to why they can not meet.

OP You say they are in the process of the K-1 Petition. So, did they Actually File yet? In other words, sent in the Petition with no pictures together, no flight boarding passes. Moreover, did they get a NOA1 yet. That is my question. I would think not.

hmmm they have never met and they are going through Lagos that is mission impossible they will be wasting there time and money. Also to try and prove hardship is tough and even if they did I dont think there is any reason Lagos will even accept. It is best they try and meet in person ASAP good luck!

To file they must prove that they have met face to face in the last 2 years or it is impossible to meet ANYWHERE in the world for the couple. Under the religious concention they must prove that it is prohibited to meet in the company of others. ( some try to prove they can't be alone together which is a not what the requirement is ) for the non religious reasons you must prove that both parties are unable to travel to meet each other. That mean the USC has no way to travel to Nigeria ( total physical inability to fly on a plane ? ) and that the non USC can't come here ( denied visitors visas can over this ) and that there is no other country they could meet in ( vacation to Mexico or the UK or Kenya for example) This proof must be submitted with the petition not developed afterward. Needless to say it is rarely approved , in my early days here there was report of a man who could no fly that was basically told to take a cruise. Even meeting now will not pass the requirement to meet prior to filing. They should withdraw this petition , make sure they meet the requirement and then refile.

Question you mentioned pictures with relatives, how did that happen if they haven't met ?

Also Lagos usually like more than 30 total days of face time by the interview.

This will not be over quickly. You will not enjoy this.

I agree with Patient2010--Mission Impossible through the Lagos Consulate! Flights are pretty cheap right now....for Nigeria anyway. :)

yes flights are very cheap at the moment check it out.... its hard to prove with out seeing each other.... goodluck...

From reading forum posts regarding Nigerian K1 rejections, that is one TOUGH embassy.

Seriously, if the couple haven't met, don't waste the time, money and energy into filing because it's a lost cause

If a couple are truly serious about marriage, and traveling to meet each other is most elementary element of their commitment, and

unless there is a compelling reason why the two can't meet, I don't see how the K1 would get approved.
