I hope Im posting in the right area. My fiance suprised me my alerting me she had recieved a 10 year tourist visa, The B2. She did so by showing up at my backdoor and a great suprise party was thrown in our honor. She stayed for 11 days and then went back to D.R. Now as the dust settles here are the questions. We want to get married in June, June 9th to be exact. The courthouse said that even though she is not of this country, she just needs a passport to get married.. (mmm.kay) What are the steps for the Adjustment of Status after we get married?

Because she went back to D.R and you have clear intent to not only marry but for her to apply for a greencard and immigrate to the US, unfortunately AOS is not an option for you anymore. She is allowed to enter the US with her B2 visa to marry you, but what she cannot do is enter this country with a non-immigrant to marry you AND stay to immigrate. That is visa fraud.

What you can do is have her come here in June, get married in the US, and begin the CR-1 spousal visa process when she is here. She can remain in the US for however long she is authorized to stay under the B2 (max. 6 months), but when that period of authorized stay expires she has to leave, return to DR and wait out the CR-1 process there. She will also have an interview at the local US consulate. There's a good guide for CR-1 process here on VJ which will outline the entire process step-by-step.

EDIT: Sorry about the confusion - just noticed you have K-1 listed in your profile..and now I am a bit confused. Are you applying for the K1 visa? Is she going to enter with the K1 fiance visa in June, and not the B2? If that is the case, forget all I said above.

Yea...didn't you already start the K1 process and awaiting NOA2? I'm not sure at all how this works with the B visa but definitely look into that.

Is she entering the country on the K-1? Assuming so, yes, she would need a passport or other government ID to marry. Everyone must show ID.
