aye im sorry yo say this but ask him what did he answer for all thew questions and its strainge if it was marked K1 and not CR-1 did you fill out all the correct paper wotk? any how we will be praying for you stay positive and dont give up. "nothing good comes easily sometime you have to fight"

He wrote a complete account of what was asked and what he answered. They kept asking him over and over how he asked me to marry him. They asked for his facebook password and looked at few photos but did not want to see all the new phone bills, webcam photos or any new evidence he brought. We saw each other on the 3 separate visits. I lost my vacation when I quit my job to move to Turkey the first time so I am just now getting vacation time. I am trying to go visit him again in February. I truly need all the advice I can get. Thank you.

You need to have him scan and email you a copy of the paper. If it's going back to NVC, it's not so he can have another interview. Read what the paper actually says and tell us exactly, not somebody else's or even your own interpretation of what it says or means.

I expect you'll find the word "revoke" somewhere in the wording, meaning they are returning the petition with a recommendation USCIS revoke their approval of it. Something is terribly amiss here and you can't get to the bottom of it without seeing that actual wording.

Given the information you are providing us, I am thinking there are two possibilities for why this happened:

1) They possibly don't believe that you are legally married or

2) The NVC could have forwarded the packet to the consulate marked as K1 processing.

The reason that I am saying this is because if it were a matter of them not believing it was a bonafied relationship, the 221g form has a box to check to return to USCIS for review.

I understand all cases returned to USCIS go through NVC first, but in this case, NVC seems to be the destination, so it could be that they made an error in processing. Of course, this is only a possibility and you won't really know the reality for at least 2 or 3 months until you are able contact them once they receive the case back.

You do have the option of calling or emailing the consulate to ask for more information regarding your case before it is actually sent out. This is a good thing to do.

Please don't sell your house and quit your job while you are in an emotional panic. Even if your case has been or does get sent back to USCIS for review, you will have an opportunity in a few months to provide more evidence or rebut any of the Consular findings. CR1 cases do not expire and USCIS has to review them if they are returned.

I'm sorry for you that your journey is not over yet. But understand that this is not the end of the line. There is still hope.

If I move to Turkey and stay there this time and sell my home and give up my job again, can we refile later and will they let us come back to the United States sometime in the future.

If you were to move to Turkey as a result of a visa denial by the Embassy and a revocation of the petition by USCIS, a mark of misrepresentation would have been placed against your husband which would make him ineligible to receive a visa. Miss smarty pants gave you the best advice in the previous post, see this thing through to conclusion.

I am hoping we can fight whatever the reason is. I did send 3 e-mails to the embassy one immediately. One when I got more information. And then one this morning making an appeal for them to please review the case again before mailing back to NVC. My husband did a wonderful job at the interview. He wrote down everything word for word. We are so heartbroken, but we have God working on our side. God will lead us to right steps I am sure.

I am hanging in there and I will appeal if they revoke. But if they do revoke, can I move to Turkey and then file another petition after we have been married 2 years in October? Will that help at all?

I am hoping we can fight whatever the reason is.

First, I don't believe that we are really sure that your petition is being sent back to USCIS yet. If it is a matter of a simple NVC mistake, it may not go back to USCIS. You need more information either from the Consulate now, or from NVC once they receive your package back. It's hard to wait and not know, but really, you can't make an informed decision until you know all the facts.

This is all hypothetical possibilities outlining some of the what-ifs:

If your package is sent back to USCIS, they will eventually review it sometime after it is received. This often takes several months. At that point, USCIS can either issue a notice of intent to revoke (NOIR) or they can reaffirm it on the spot and send it back to the consulate for re-interview.

If you receive a NOIR from USCIS, you will have a certain amount of time to respond to their issues with your package. That would be the appropriate time to submit any and all additional evidence you have for whatever their issues are against your case. The letter they send you will tell you exactly what they want from you. Your rebuttal must be received in the allotted time they give you to respond.

Once USCIS receives your rebuttal package in response to their NOIR, they will eventually review that and they will then make a decision to revoke or they will re-affirm. If they re-affirm, then it goes back to the Consulate for re-interview. If they revoke, then your only options are to either accept their decision, or appeal. An appeal is a very long, lengthy process. It is not easy to overturn a final USCIS decision on appeal, but it is possible and does happen. That's why your response to a NOIR, if you receive one, is so important.

If the Consulate doesn't respond to your emails, it may take a few weeks to a couple of months for your package to be received at the NVC before you will know which way this might go. Remember that you still don't know what problem the Consulate found and until you know, try to think of it just as a bump in the road. Since you have already emailed them....have you tried calling them yet? Maybe someone there can give you information on the phone.

If you still don't get answers that way, try to get one of your congressional representatives involved to help get information for you. They will make you sign a release of information form. I would make a personal visit to their local congressional office. They tend to be much more helpful when you are standing in front of them.

None of this information is intended as legal advice. These are simply the steps I would take if faced with the same situation (God forbid!). I am not a lawyer.

Don't move to a worst case scenario yet. There are still a couple other steps between things as they are now and a revoke.

For now, just try to get more information.

Thank you. They will not take phone calls at the Embassy. They only take e-mails. I already have a Senator involved who has been involved for several months. I contacted an attorney that said to contact her when I receive a letter stating the problem. I am hanging in there. I just want to know if this petition is denied after all appeals, will there ever be a chance he gets to come to America because if not, I will sell everything and move to Turkey. I can not just let him stay in Turkey without me. I married him.

The paper says more than that. Forget about any reference to the wrong visa. Quote the entire sentence that contains the word "return".

I hate to break it to you this way, but if there is any truth at all to the "Come back in an hour and a half...." story, then the checked out one or two of the things he said in the interview, caught him in a lie, discussed things with a supervisor and denied the visa. Again, you'll probably see the word "revoke" or "revocation" in the sentence containing the word "return" and the word "ineligible" in the opening relevant paragraph. Time to get your wits about you and read carefully.

If you've been sending money, you'll want to stop now.

you need to try and keep the petition at the embassy. Email them. Tell them you want a 2nd interview and you should be there.

Tell them the paper is marked K1. Is this an error or do they think it is a K1 petition and that is why they are sending it back?

Drop the lawyer cause a lawyer should help you before it is returned.

Gather ALL evidence.

all chats

all webcams

all webcams with his family

all webcams with your family

receipts of anything you bought together

life insurance on both people

health insurance

joint credit card

any magazines with BOTH your names on them

Any birthday party invitations with BOTH your names on them.

Joint bank account in Turkey

Hotel receipts

airline stubs

receipt for ring purchase

Gather everything now and organize it with a cover letter explaining what each piece means.

When you call them be ready to ask for a fax number and send all this information if they let you.

Do not sell anything yet.

I want you to ask your husband if he s or was speaking to any other girls online. I have heard of 2 stories where the embassy knew he was cheating and she did not. and they returned petition because she did not know about these women. If he says he did talk to people-get their sign-ons or names and include this information in the packet. I hope he hasn't spoken to anyone but this is one reason our embassies will send back petitions and not tell us wives. Make sure he knows this and if he is serious about wanting a life with you then he needs to tell you everything so you can explain it in your letter also.

Information is power and if you want your man then you need all the information.

Also, research VJ and see who else has the same differences you do as your spouse and read their problems and solutions and contact them

We had all these things but they refused to look at anything. He only has the same friends I have and I have his facebook password.

He has done nothing wrong. We were in background checks forever. It took from November 2010 to the end of August 2011 just to get the NOA2. This is just a sad situtation. The good news is that one day we will live together even it is not in the United States.

THe embassy will not take phone calls. I have e-mailed them 3 times. The lawyer said we cannot fight it until we get a letter from USCIS. My senator is still involved and knows that the petition was being sent back to the US. This is just in God's hands now.

You are being very Passive about your future and destiny. What I have told you is the right info.

You are asking for advice but then you chose to ignore it or debate it and say your lawyer said...well if your lawyer said it then I guess just sit back and wait 6-12 months so you can do something. Then sit back and wait another few months and see if they grant him an interview or denial.

With your plan (NO PLAN) you will be separated for another year or more.

Not everyone chooses to sit and wait around for embassy to destroy you. People have fought and kept their file at the embassy. People also have sat around and cried "Why me?"

And SOMETHING was not done right, something was done wrong....cause they sent it back. so take an honest look at things from outside your love and maybe you will see what went wrong.

I wish you luck but now I am afraid with your defensive attitude that you will need more then luck.

When you write the embassy be sure to ask what facebook or email account did they have him open at the interview. Maybe he has more than one facebook?
