dear all,

I came in usa 2 month ago my wife is usa citizen and im green card holder. my wife is pregnant and want to invite my parents to take care of her delivery.what visa i have to apply and what is procedure for that?

'taking care' = work. B2 visa holders are not allowed to work, whether paid or not. Hospitals have nurses, nurses provide care for infant deliveries.

There is no procedure for this. While it is common in many cultures for parents to come to stay to care for a newborn grandchild, it is not accepted as a reason to issue visitor visas to grandparents. In fact, it is the opposite making it much harder to get visitor visas because taking care of a newborn is considered work in the US.

In the US, there is maternity and paternity leave where both parents can take months off from work to care for a newborn. In addition, there are child care services. This is considered work. A grandparent on a visitor visa doing this activity would fall under illegal work according to the US government.

The best advice to you is to carefully prepare what your parents will say. It is acceptable to say that they want to visit the US and celebrate the birth of their grandchild. NEVER EVER SAY - they want to visit to provide help or care for the newborn or the mother.

Whether your parents will get visas will be primarily based on their strong ties to their home country; jobs, real estate, family, money, etc.

then they should apply for a B1 temporary work visa. Probably best to talk with the director of the hospital where they work, to get permission to leave the jobsite for a few months.

I sincerely doubt that his parents are medically trained.

You send nothing.

Your parents must apply on their own for tourist visas. They can download the forms at the US Embassy's website.

B1 is for Business not work.

They have to show strong ties to their home country in order to get a visitor's visa and they have to apply in their own right. You can't apply for them. Strong ties include titles to property, secure/ stable employment, community ties, etc

If approved for a visitor's visa, they would only be able to stay in the US for a maximum of 6 months unless they applied for and were granted an extension of stay.

A B2 is not the easiest thing to get though...

B1 is for Business not work.

I KNOW !! His parents seemed to be coming for work, to deliver the baby at the hospital.

They have to apply. It's THEIR VISA, not yours.

Drill around on the US Embassy Website where the foreign spouse's visa was approved - you'll find the exact steps and forms.
