Hi everyone!

My husband and I are going to have our AOS interview this coming February 3rd, 2012. Since it's the new year, I'm thinking about his tax returns for the year 2011. One document that's being requested is the recent tax forms, and it happened that our interview is in the start of the new year. When do people get their tax for the past year? Do you think we'll be able to get it before the interview, or it's too early for that?

Any help is greatly appreciated! Thanks mucho!

2010 is the recent year, just did our AOS interview, the IO didn't ask for last year taxes. Interview was quick and relatively painless, we were over prepared. The IO's comment was if you were not prepared I would have sent you away. Oh, thank you so much for your fast reply! So, I just want to confirm.. For my interview this coming February, 2010 is still our most recent tax year? :)

Yes. USCIS gives everybody until the tax filing deadline before they require the next year's return. Anybody interviewing after April 17, 2012 could be asked for the 2011 return because your taxes are supposed to be finished by that date.

Also anybody mailing in a new AOS and I-864 can send 2010 as the latest tax return up until Apr 17. They won't RFE for a new one on April 18. It's supposed to be your latest on the date the form was signed. If they have reason to think something has changed in the income, they could ask for a 2012 after Apr 17, but generally go with what was in effect on the day the I-864 was signed.
