We have been married about 6 months and adjusted status a month ago. She got her green card in the mail and it is a permanent resident 10 yr green card. I'd like to hear from people to whom this happened rather than people telling me what the law says or speculation about what will happen at ROC or the citizenship interview.

Did you call USCIS and they sent you a new one? (also, how did they do that? She mails her 10 yr in and hopes it does not get lost in the mail while they prepare her new one?)

Did you apply to remove conditions as if it were a 2 yr card and if so, what happened?

Did anyone let this ride and if so, what were your consequences?

I would appreciate firsthand knowledge of this. I have seen on here where this has happened to people but not seen follow-up as to how they dealt with it later or what issues arose because of it.

The best thing is to know what the law states rather than what others have done. Asking others not to tell you what the law states is knowingly refusing right counsel. While others who had been dishonest may not have had any repercussions from not mentioning it, you may. It is better to be honest about it than rely on the action of those who knew better but may have chosen not to do better. It's best not to feign ignorance. Be honest and let them know. Don't count on others to be your conscience based on what they did. Also, if you had gotten a 2 years conditional when you should have gotten your 10 years GC what would you do? Keep the two years or return it for the correct one? Think about it. It's a no-brainer. Be honest and let them know. Return it.

The best thing is to know what the law states rather than what others have done. Asking others not to tell you what the law states is knowingly refusing right counsel. While others who had been dishonest may not have had any repercussions from not mentioning it, you may. For evidence that she is able to work use the 10 year greencard to get her a new SSN without the restriction printed on the face and a State Issued ID Card. Then you can return the Greencard for correction and she'll still have enough documents for the I-9.

I plan on calling USCIS--was just hoping to hear from someone who had been through this including how they return it as at the point we send the card in I am not confident she will have evidence she is able to work here legally or that USCIS will promptly handle the situation. I know there was at least one person on here in this situation that had their check and app sent back to them because they were already listed as a permanent resident. I was wondering what the end result was.

I see what you mean. The wording of your post appeared as if you were not interested in what the law states but what others have done. I would ask USCIS how to go about doing this. Make a copy of the GC as well. Did she get an EAD? Maybe she can continue using that until her GC is mailed out. All the best.

I am curious how they do it logistically as it would seem they would not have you mail it in leaving no evidence they can legally work but I'm sure they would also want to be sure her erroneous 10 yr green card is not in circulation. I'd make an Infopass appointment. They may also be able to give her an I-551 stamp while she is waiting for her new GC which would allow her to work and serve as her "green card" in the meantime.

Make an appointment with them and check them what needs to be done.

Going in future, if they ever determine USCIS had mistakenly sent you a wrong card normally it would be your responsibility to get the mistake corrected.

Ex. If the GC would had typo in the name, its your responsibility to go over it read all the details and make sure they are correct, in case of typo in name you would contact USCIS and get it fixed – similarly this would be your call to get it fixed.

The only problem with getting the I-551 stamp is that it isn't as widely accepted as a Greencard in hand. In Illinois for example you can;t use the stamp to get a State issued ID.

You might want to talk to manager or some senior official. I had little hard time changing my add on DL with I-551 stamp person at the counter had no clue what it was and manger had to call someone to validate it and on top of it they only issued the new DL with 1 yr validaty as the stamp is valid for 1 yr only.

So yes with stamp you have to go thru some hassel, but for travel and for immigration status point stamp is always good.

Ah, I was unaware of this. Still, for work purposes it should be accepted.
