Can you expedite if your spouse is in danger?

Well here is goes....my husband's father was killed in November for "X" reasons...and the guy that killed him is threatening my husband as well. This is a serious matter and I get scared every time my husband leaves the house...so I wanted to know if that could be a reason to expedite his case seeing that his well being is at stake :crying: (I have his fathers death certificate stating the way he died as proof) so what do you guys think?

April 2007- Met while I was in sophomore year in high school by his house

December 16th 2010- engaged

May 28th 2011- married in Sāo Paulo<3 <3

July 13th- Sent I-130

July 15th- I-130 received

July 18th- received NOA1

August 1st - touched

Sept....Oct..Nov...Dec...Waiting -__-

January 24th- received NOA2 via email

January 27th- recieved NOA2 hardcopy

February 1st- NVC received

February 7th- got my case number

February 7th- got the IIN number

February 10th- payed AOS fee

February 14th- AOS PAID!

February 15th- payed IV fee

February 16th- IV PAID!

February 23rd- sent AOS & IV packages to NVC

February 24th- packages delivered at NVC

February 29th- recieved checklist

March 5th- sent back checklist items

April 30th - interview

Timeline

I would think if the killer is at large and he is being threatened or has police reports stating so then it is a reason to expedite.

I would try it immediately.

Do not call USCIS. Send and email and attach the evidence when you have it all.

Write professionally and not emotionally.

I would say No ! If in fact this person killed your husbands father he would be under arrest or in jail. Therefore, not a reason for Expedite.

You would need proof of threatening letters, calls, etc. and these would have to go to the police and verification of the reports. These reports would go to authorities and a investigation. The investigation would lead to an arrest or heresay and not enough proof against the assailant. This appears to be the case.

USCIS and/or NVC would take no action for such an Expidite based on accusations that your spouse is in danger.

I'm sorry about the traggic news but if this man is free he was never convicted. If he was tried in a court and got away with it and sends threats, that is different. But, the police would arrest this person immediately.

So I say No!

(If) these threat are real, what makes you'll think these same threat won't reach him here in the US. If this is some sort of gang related issue, this won't go-away one he reaches US soil. Have a polie report been filed in Brazil? If not, why haven't your husband filed one, it doesn't matter if you'll feel the authorities won't do anything. It sounds as if you'll are not doing anything about it too. The US govt will be looking for some type of action on your husband part on trying to protet himself.

Go file a Police report.

Okay, then how can you expect the US government to expidite your case base on your statements alone? They will need documentation.......

Can't offer anything else, if it not documented, then nothing can be done.

I think if you have the death certificate and any other evidence that your spouse lives in a BAD area of town then you can try for the expedite. It will not hurt your case.

I seen a fiance request an expedite because she could not afford to visit him cause she had no more vacation time....

So, give it a try. You will never know unless you try.

I suggest the email cause I seen too many people denied when they request over the phone

You are relying on some call center person to put everything important down and they usually leave out important stuff
