I understand you need to get her here to the US before she gives birth so her waiting to come until you have block leave is out of the question.

I also agree a proxy marriage is fraught with potential issues so I wouldn't go that route.

My suggestion is have her arrive at your mothers house and sleep to get over jet-lag. Then I would have her fly to you (possibly with your mother who can witness the wedding) and get married in the court house on the w/end or whenever you can get a couple of hours free. Heck if you can't I'm sure you're not working 24/7 so you could organise a celebrant to marry you in a garden or something nearby when you do get an hour or 2 to yourself.

It would be cheaper to pay for her to fly to you and stay in a motel/hotel so you can get married than it would to do the $1000 proxy thing.

^^ With his wife being seven months, I don't think it is advisable for her to travel that long especially that direct flights to the US are a rarity especially if you are not in HI or CA. She might need to go "nation hopping" before arriving in the US.

I wouldn't risk 7 months in a flight because there is a high possibility of early birth. It is not good to give birth in the airplane or the airport.

Direct flight to CA from the Philippines takes at least 13 hours

I just talked to a agent. In Colorado it is legal to just go to a court house and do a single proxy marriage, you can even do it while the spouse is in the K visa Status. (Meaning really I could of married her awhile back and still received military benefits , while working on K1 Visa because uscis don't consider it valid until commusated.) Like you said its not official till its consummated, meaning within 3 months I have to get her in bed. Hmm How do I prove that one ? Good news is that Proxy marriages were primary used for Military to begin with , so they would accept that for getting benefits such as BAH and enrolling her into deers, Its just proving to USCIS , which I was told could be done by simply having another ceremony when were both togather , or writing a sworn statement that says

"I, Jane Doe, declare as follows:

I have engaged in sexual intercourse with John Doe after [date of wedding]. I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. Signed on [date]." The signature must follow the statement. No notarization needed.

Of course this is my last resort. I just want to be with my wife and baby and see my child born.

Fortunately , my unit is not scheduled to deploy anytime soon... so hopefully i don't have to have the worst case scenario lol.

no , I don't want to marry her now , althought this whole process ( as far as paying for everything ) would of been a ton easier , but if I take this route im just going to wait till she gets here and see how things are going to see what we need to do. I guess if it comes down to it I could send pictures for proof! ....

Marry her EARLIER for military benefits so that she is covered by his medical benefits before she gives birth to his child. It will mean that he/they won't have to pay ridiculous fees for her to give birth.

That is the thing. The USCIS, esp the US Embassy in Manila is very cautious of such things. Theya re likely to consider that as "marriage of convenience".

Not trying to demonize the OP but he should really take precautions esp with the USCIS. They take the smallest things seriously to the point that a child conceived out of wedlock but born in-wedlock(couple got pregnant before getting married but baby born after the marriage) go under DNA testing regardless of pictures and documents.

The OP should not take the USCIS lightly. Maybe he would not have problems with the military but likely with the USCIS

Ask your CO for a 4-day pass. You can do this, it just won't be all about taking your time and making it last for the memories. It'll be high speed low drag to get here here, meet up with her, get hitched, hit the sack,and get back for formation. But you know the Army, you dont have to like it, you just have to do it!

I'm sorry but they didn't expedite because of the pregnancy. They expedited because you were military and could have been deployed at any time. They will not expedite because of pregnancy, it is important for people reading to know this.

When I called them I called to expedite , They asked what reason , I said because my fiance is pregnant , I am supporting her with single military pay , and I would like to get her here before the birth so the child can be born in America. They emailed asking for documents to support these facts along with military ID. I faxed them the sono and the ID , 4 days later it was expedited. You don't have to be military to get a expedite , there is like 20 options when you call they tell you to choose from , then its up to the officer. Sure maybe military had something to do with it , but I know the reason I called. I'm not deploying anytime soon ,and s lot of deployments are stopping. Anyway , My unit isn't the best. 4 day passes aren't really something you ask for around here , You get them when the 4 day weekends roll around. Here its Army first , Family second. Which I don't agree with , but like you said I just have to do it.

No no no hating from me Trust me had you not sent military ID you wouldn't have got the expedite. I'm happy it worked for you but there are lots of people who try and get expedites thanks to them being the USC and being knocked up, or having a pregnant SO outside the country and it doesn't work, it's not a special reason. Military get special treatment, us "normal people" don't

So you don't even get your w/ends to yourself? What about you plan for her to go to you for just a w/end with your mum for instance, and then have a celebrant do it during your time off. You're probably on a scheduled shift right? You can't work 24/7. There's gotta be a window somewhere. Say you work 9-5 for example? You could organise for the wedding to be done at 7pm or something by a celebrant, go to dinner afterwards, bing bang boom it's done AND you get to see you girl for a couple of hours .

I suggest you speak to your CO for some options, I'd hope they've give you a pass off base for the night or something...
