Buenas, tengo una pregunta.

En este momento estoy en el proceso de la K1. Pienso que cuando la tenga llegar y casarme con mi novia un par de semanas después.

Mi pregunta es luego de casarme puedo salir de USA?

Mi hermana se casará como 2 meses después de mi, pero se casará en en Venezuela. Tengo que pedir algún tipo de permiso?

Qué debo hacer?

Hi, I am from Venezuela, and I am on the process of my K1 Visa.

I want to know if after I get married in the US i can leave the country for a week.

My sister is getting married 3 month before I'm going to arrive to the US, and I have to go to her wedding, and she is getting married inVenezuela.

What can I do? Do I need a permission for that?

no puedes :@ Tienes que mandar tu AOS y esperar por tu EAD y AP para poder regresar.

If you are applying for the K1 visa you MUST get legally married in the US. You may have a ceremony in your home country afterwards (non-legal), and sometimes before (again NOT a legal ceremony) but before is risky.

You MUST also remain in the US until you have filed AOS (which you do after you are legally married in the US) and have either received AP (advanced parole) or the GC. If you leave before you have either of those documents you abandon the AOS process and must apply for another visa.

First of all how do you know when you will be arriving in the US? Please fill in your timeline, it helps people give you better answers.

After you arrive in the US and get married you will have to file for AP if you want to travel outside the US before you have a green card. It takes 3 to 4 months after you file.

November 21st 2016 - Sent N-400 to Dallas Lockbox.

November 30th - Check Cashed.

December 1st - Email/Text Notifications.

December 8th - Hardcopy of NOA received (Priority Date 11/25).

December 9th - Biometrics Appointment Letter received.

December 19th - Biometrics Appointment.

January 4th 2017 - "In Line" for Interview.

June 9th - Online status changed to "Interview was Scheduled".

June 12th - Interview Letter received.

July 19th - Interview (NYC). Requested a "delayed Oath" for after September 4th 2017.

September 11th - Oath Letter received. Honored my request for a delayed Oath Ceremony. 

September 14th - Oath Ceremony.

When you arrive in the US and you are legally married to your partner you will have to file for adjustment of status (form I-485). When filing adjustment of status you can also file for a work authorization card (EAD) and Advance Parole (AP) - Advance Parole is permission to travel outside of the US whilst your green card is being processed. It is free to file EAD and AP with your adjustment of status application.

Once you are married you CANNOT leave the US under any circumstances unless you have been given permission to leave by the US government. Permission to leave the country is given to you when you apply for Advance Parole and can take up to 90 days to process and approve. Of course if you get your green card approved before you receive your AP then you are free to travel anywhere. Please may I add, if you have ever overstayed in the US at any point in you life you are advised not to travel outside the US until you have you green card. Do not use AP in this case as you may be denied entry or even banned depending on the length of your overstay.

If you leave the country after you are married but before you have been issued with either your AP card or your green card then you will be seen to have abandoned your adjustment of status application and will have to start the whole process again. You can expediate your Advance Parole application in extreme circumstances, however I don't think going to your sister's wedding will be a justifiable reason.

Precisely, anyone can LEAVE the U.S. at any time. Getting back in can be the problem. As the quoted poster correctly states later, Advance Parole potentially gives the immigrant the right to re-enter the U.S.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes you're quite right. I guess when I give out advice, I expect people to not take such comments so literally and use common sense, but I think I should choose my words carefully. The US is of course not a prison and you are free to leave at any point, as agreed with TBoneX it is all about your right to re-enter which may be the issue here.

One other consideration - the K-1 visa is itself valid for 6 months. If your sister's wedding is going to be close to the time when your K-1 visa is issued, you could delay your own arrival in the US until after her wedding. That way you won't have to worry about getting your green card or your travel permission in time to travel to her wedding.

The K-1 visa is good only for one entrance to the US - but you can make that entrance any time from the day the visa is issued until its last day of validity 6 months later. When you get to the US, the K-1 visa is no longer relevant. You get a new immigration document called an I-94 and this is valid for 90 days. You need to get married within those 90 days, and if you wish to be able to travel outside of the US, you will need to apply for your green card (I-485 aka AOS petition) and at the same time, request permission to travel (AP or Advance Parole) while waiting for your green card. Travel permission will take about 60 days after you apply so you may just want to wait and delay your arrival to the US instead.
