Parents want to file for citizenship, question I have since they haven’t stayed continuous in the US. They travel twice a year and stay about a month each visit. They have been permanent residences since 1996.

They haven’t filed tax returns since they never worked in the US, I had filed for them the last 3 years. So on the application should I put they haven’t filed tax returns and if they get an interview just bring in paperwork to show that they can support themselves? Or send in bank statements with the applications?

Do you file them as your dependents on your taxes?

Do they live with you?

If they have money in the bank then I think the government might want to know if they make enough in interest or dividends that they should have claimed thier own taxes.

They have been here since 1966 and they never worked. Wow. I wish I could do that. I will work many more years. lol I am just a nurse.

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

They will need to proof that they were not required to file an income tax return. Had you asked me this question in 1996, I would have suggested to file an income tax return every year anyway. It may be a good idea to provide proof how they can support themselves if they have no income, don't get any dividends, have no capital gains, etc. I assume your parents worked hard before immigrating to the U.S., and they have substantial savings in the pillow or in the bank but not enough to trigger the income level requiring them to file an income tax return. They are probably also very thrifty. All of this is fine, but, again, showing this to the I.O. might be a good idea, if he or she asks about this.

So just to clarify... You said they travel twice a year and stay about a month... so is that they LEAVE the US twice a year for a month, or they VISIT the US twice a year for a month? That makes a difference. You post makes me think they actually live in their home country and visit the US twice a year... How are they supporting themselves? Do they have income outside the US?

Regarding taxes you said they've never worked in the US and you filed for them the last 3 years... does that mean you filed them as dependants, or you helped them file THEIR taxes for the last three years?
