excuse me, but I read in this thread that the USCIS doesn't need any evidence except that you've met in the last year. Did you at least provide that?

I feel sorry for both - OP and her fiance, but I can't agree with point of view that only her USC fiance is guilty. K-1 process requires a lot of work, and I think it's not right to put everything just to one person. Both in couple should work on it if they both want to move together. I wouldn't feel myself good if I would ask my Amy to do all work about K-1 by alone. At the same time I would be slightly offended if Amy would tell me something like "prepare all by yourself, just show me where I need to put a signature". We have been working about everything together and we prepared our petition package together, sitting at one table, while Amy visited me for the 1st time. I hope it doesn't sound rude, but both should learn the lesson, and I sure if they will start to work together, 2nd attempt will be successful. :)

I wouldn't feel myself good if I would ask my Amy to do all work about K-1 by alone. At the same time I would be slightly offended if Amy would tell me something like "prepare all by yourself, just show me where I need to put a signature". We have been working about everything together and we prepared our petition package together, sitting at one table, while Amy visited me for the 1st time. I hope it doesn't sound rude, but both should learn the lesson, and I sure if they will start to work together, 2nd attempt will be successful. :)

The way your relationship works isn't necessarily the way everyone else's does.

I did every single piece of paperwork for the entire process by myself. I just showed my husband (then fiance, obviously) where to sign. That's the way it worked for us. I'm very detail oriented and I had the time to do it. I don't necessarily believe that if the couple works on it together, it proves somehow that they both want it to work out. Some people just do things differently.

I agree with you. It takes 2 to get all this work done. At that time my fiancee and I decided to apply for K-1, I was busy teaching, taking classes and working. He was working full time as well. We agreed to schedule a time for a skype call and filled the forms together (took like an hour or so). After filling forms, I e-mailed them to my fiancee to make sure everything was correct and for him to sign them. He gather the rest: notarized-translated birth certificate; copy of passport, passport photos, proof of relationship. He signed everything and sent all that back to me. We did a last doulble check and I was able to sent everything the day after I received all the documents from him.

Without the help of my fiancee, I was not gonna be able to sent the documents so quickly.

We got denied on our first application last Feb, the reason is lack of evidences and my hubby didn't include our proof of genuine relationship, then after that, we decide to just re-file cause appeal is not really sure if how long does it take until they could re-open the application and takes lot of $$,or else it could be useless.SO, when we refiled my hubby did all the necessary papers,evidences completed, he double ,triple check over and over before he sent it,and he wrote a letter that explains why we wanted to re-file, and then after few days, we got the noa1, and the waiting time begins on our 2nd application after 5months and 1 day we got the NOA2 approval with (No RFE)Thank GOD. in my opinion just go on re-file.... It says we have 33 days to appeal the decision, otherwise, we will have to do everything again. (We will try our best and double check everything everything this time...)

I am not sure how long it will take to get our case reopen or it is better to apply for k-1 again?

Anyone has experienced this before?

You must have some idea of why it was denied. We need to know that to be able to help.

Do not give up at this point. In my own case & others I have seen there were denials. In mine we submitted more info while asking for consideration. Our case was resumed & approved. Timing is important now.

Just a tip for the next time you file, it may not be worth much but I am also very "detail oriented" and it helped me with my petition. After you have a reliable checklist of what you are going to send, and check off every single item (including evidence, of course) assemble your package. Then wait a day and take a good night's sleep before you send it. Print out a new copy of your checklist and go through the items again with more time and after a nice rest. You may find you left something out in your initial hurry and excitement. Or just that you rock and everything is in order.

I sympathize with you. I think that, if left alone, my then-fiance would have forgotten a couple of things before sending the petition. Two brains work a lot better than one, so next time maybe work as a team (as you will all the time when you are married anyway). All it means is that you have more time to prepare for the next stage of your life. You'll get it right next time. Good luck.

Thats how I did it too, I got everything together, told him what information I needed him to mail to me, I emailed him the forms filled out that he would need to sign, he printed and signed then mailed those with the other information I needed. I had the time to do it and I had spent a lot of time researching on the forums what needed to be done and I understood the process. Yes its nice to do things together, but in all reality, this is your visa and it really effects you more than it does him because your the one that has to move and give up your job and home and you need to know how much time you have to get everything settled, better to take control of the situation so you know its done correctly. Definitely feel free to send me a message or anyone else if you have questions we have all been through this process and understand the ins and outs pretty well by now lol :thumbs:
