Does someone know if USCIS can fax over copy of NOA1

Hi everyone,

I've filed AOS from a K1 almost a month ago and have received the txt and email confirming the receipt of my application, however I just saw online that on the I-131 application they just updated saying that the form I-797 was returned to them as undeliverable.

That is true because my husband has an old problem with the post office and we can't get mail delivered to our house at all.

But we have a PO Box and I wrote everywhere I could that we have a mailing address but obviously they don't care to look on the details.

Now I have a big problem because I want to start college next week and I'm already enrolled to classes and all but they say that if I don't show them that hard copy letter until this Thursday they can't let me pay in-state tuition. That means I have to drop out of school and wait for next semester or pay $3500 more as an out of state tuition!!

So basically I will call USCIS tomorrow first thing and make sure they send it to our PO box, but I don't think I can get the letter mailed so quick!

Does anyone know if they agree to also fax a copy of the I-485 I-797??

I swear this process is just so hard, every time you think you got ahead you realize there is another problem.

A fax would not be a hard copy it would be a fax. Printed on regular paper not the special paper they use for hard copys they mail.

Its not likely they will fax it.

Well after talking twice to USCIS costumer service and going to my local office to talk to them, here are the results:

1. I should have put on all of the forms my PO Box and not the residence address. The advice to put on the residence address I got here on VJ was wrong. they do not care about it. they care about where they can send mail to you.

2. They can not or will not fax over or even personally give me a copy of the I-797.(NOA1)

3. I have filed a service request with the costumer service to change my address and re-send those notices to the new address. That should take about 30 days! great that really helps... :whistle:

4. At the local office it wasn't even updated that my letters were sent back as undeliverable and they couldn't do anything for me but advice to request an expedite.

5. I have called again and asked for an expedite on basis of financial loss (it will cost me $4000 more in tuition if I do not get the letter until January 12th) just for the receipt notice. I hope the very intelligent representative understood me.... that should take at least 5 days anyways.

6. I have filed an AR-11 form online to officially change my address on their files.

Now the weirdest thing is I just checked my case status again and all of a sudden it says on both my I-485 and I-765 applications-

"Card/ document production" and that I should receive the card in 30 days!

What the heck is going on here? can someone explain this???

p.s it seems like talking to the costumer service is a waste of time. They don't know anything and also do not seem like the sharpest pencils in the box. So who can I talk to that could actually give me some reliable information??

First of all I couldn't find it and there is no need to be mean to a person that's in a big stress right now.

Second, what is an ISO anyways?

Third, I think I have already dealt with the re-mailing problem but the problem is it's going to take so long until I get those letters and I need them now.

Fourth, can someone please address the weirdness that's going in with my case status now?

Did you put the PO Box in the "care of" like I told you in the prior thread? It should have been fine that way. That's what we had to do because we don't get street delivery either.

USCIS makes mistakes, it happens. The 1800 number is nicknamed the "misinformation line"... so I'm not surprised they were less than helpful. I would make an INFOPASS appointment if you want answers. Maybe (and I can't guarantee this) they can generate another NOA1 then and there. I know they've done it for biometrics so *maybe* they can do the NOA1 as well. They should re-send you the NOA1 now that you've "fixed" your address.

Will the school permit you to pay off your tuition in bits so that you have a little more time to show them the NOA1? Will they refund you once you show them the NOA1? Will they accept you showing them the print-off online of your status showing the mail wasn't delivered? You shouldn't be penalised because USCIS/USPS messed up...

Vanessa, yes I did put the PO box on the care of section and on the cover letter and on post it notes on every form asking to send all mail to my mailing address which is the PO box.

That's why I'm so upset, they should put a line in their forms for both residence address and mailing address!!!

I did go to the local USCIS office yesterday with an info pass and they didn't help at all, their files weren't even updated with the undeliverable problem at all! And I even got to the point of crying in front of them and they still wouldn't give me a copy of the NOA1 or any other letter confirming that I am legal here. What if a cop pulls me over and I don't have anything proving that I am legal???

Last week when I talked to the supervisor at school I told her I've got the email confirming that I have applied for GC but she said she needs the formal letter. And she said she'll give me until January 12 to come up with it. Tomorrow I will go there again and see if i can get some sort of agreement with them like you said- to start paying like out of state until I get the letter and then if they would refund me the difference that's fine with me. But I don't know if they'll agree to do that.

If anyone has any idea how I can talk to someone who knows something or what does it mean that all of a sudden the website says their already producing my GC and EAD only 20 days after filling????

Unfortunately life is seldom fair...

Since there doesn't appear to be a way to get an original NOA1 within the next 48 hours you'll need to decide which will have more of a negative impact on your life (immediate and future) and weigh your options.

The fun of dealing with USCIS is even if it was their fault that deliver wasn't successful you (we) as the applicant will bear the consequences of the misstep and there really is nothing any of us can do to change that.

OK update, I went to talk to the supervisor at school today and she exceptionally gave me another extension to come up with the I-797 until February 1st, and she updated my status to in-state but she said that if I can't show her the letter be that date I would have to pay the out-of state tuition.

So please someone tell me how can I talk to a supervisor at USCIS and verify that they updates my mailing address and that they are sending it to me asap so I can receive it before Feb 1st? I've already tried info pass and they couldn't help me at all so please how can I speak to someone at the costumer service that know what they're doing?

Also after my I-485 and I-765 were under the weird "card production" status for 2 days now USCIS finally received back these two letter as undelivarable (like I knew they would) and the status has changed back to initial review and that I need to update my address even though I already did it when I first saw that my I-131 got returned to them.

How can I talk to someone at USCIS that can confirm the address change and that they are mailing those I-797 to my right mailing address?

The only way I know is INFOPASS and calling the 1800 number and speaking to a Tier 2 immigration officer. I'm sorry, this really sucks :(
