My wife and I plan to travel to the Philippines in June 2012 for 2 weeks. Her 2 year permanent residence expires in August 2012. We plan on filing for removal of conditions in May (within 90 days of expiration date). Just want to make sure that it's ok to travel in this timeframe, and what if our biometrics appointment gets scheduled while we're out of the country (and is received after we're gone - and therefore we don't know about it and miss the appointment) - Do they give you a few weeks notice on the biometrics?

They give you a couple of weeks notice but you do not want to just miss the appointment.

You are eligible to file 90 days early but you don't HAVE to so long as you file before the GC expires. I would suggest you go on your trip and, as it is only 2 weeks, file for ROC when you return. That way you won't risk missing anything.

My wife and I plan to travel to the Philippines in June 2012 for 2 weeks. Her 2 year permanent residence expires in August 2012. We just went through the Removal of Conditions for my wife. Her GC expires on 12 Jan 2012.

File early in your window and you will get a biometrics appt. in the mail well before her card expires. I sent the package 10 Nov. and our bio appt was for 7 Dec. After biometrics is done, you will get a letter in about 8-10 days granting a 1 year extension to her card. Make sure she carries this letter with the card after it expires.

I went online and the current timeframe for approval and card production is 6 months. Ouch

Rescheduling is easy but the USCIS will assign a new date, you cannot ask for a specific date. I tried to do that and was told no because info is entered into a computer and the computer generates a new date based on vacancies, manning etc. Groan, so I had to burn a vacation day to go instead of a standard day off. oh well, my asawa is well worth all the Government hassles.

Do you have someone who can get your mail while gone? Have them look for your bio appointment letter, open and see the date. If the date is during your travel, they can reschedule for you.

Thank you both for your responses. I think we've decided to mail the form the day before we leave on vacation. No way will they have us scheduled before we get back, and this way we won't delay the process by the 2 weeks that we'll be on vacation.

Good idea. This is actually what we will most likely do as we will be traveling during my husband's 90-day ROC window as well. It's hard to know exactly how long a biometrics letter will take (ie our local office was backed up so they were taking 2+ months last year), but since you get them at least 2 weeks in advance even if you got it within a week or so you'd still be back in time. :)
