Hello everyone,

I have a question and need some help; I have applied for a K-1 visa which will be going through the US-Embassy in Manilla, Philippines. I would like to get married over there when the visa is issued, then bring her back with me to live here, another marriage here also. I will be traveling to see her before the anticipated NOA2 notice and would like to apply for a marriage license at that time and then wait for the K-1 to be approved then get married to her with family and friends present!

So, will this be reason for denial or cause undo complication with the approval?

You are required to marry in the USA on a K-1 visa.

If you want to marry in the Phils you should cancel the K-1 now and go marry her in the Phils then file a Spousal petition instead.

If you marry and then try to enter on a K-1 that is mis-representation. You cannot adjust status because you are already married and did not abide by the rules of the K-1.

Your interview took 67 days from your I-129F NOA1 date.

You can have a ceremony in her country. But you cannot really get married.

You have to get married in the USA. You signed papers that stated your intentions for the government to approve the fiance visa.

You cannot enter the USA married with a fiance visa--that is fraud

If you just want to have her family present then have a ceremony with them.

Firstly, you have not applied for a K1 visa, you have filed a petition on behalf of your fiancee and if the petition is approved by USCIS, your fiancee will be able to apply for a visa from the Embassy.

Secondly, what you are asking about is not possible. A K1 visa holder must be unmarried and then marry the petition within 90 days after arriving in the US. If you two get married in the Philippines, it will void the K1 visa (your wife would be turned away at the POE) and you would have to start all over by filing a spousal visa petition.

The K-1 Fiancee Visa program is intended for the marriage to occur in the US. If you marry her in the Philippines, she will be your spouse, not fiancee.

Yes, I will plan to have a religious ceremony then without the marriage license... Thanks
