Hi ... I have a question regarding the affidavit of support.... This is taken from the tips section on this website "The foreign fiance's income can NOT be counted on either affidavit (except when the foreign fiance has been

living with the fiance, married, and in the US for six months), however the foreign fiance's assets CAN be used if they are readily convertible into cash."

So my question is ... I own a house and have savings. But my finace in the US does not have an savings but does have a full time job. Does me having savings and a house in the UK help our petition?

Does your fiance's full time job put him over the poverty line though? if it does you won't need to use any assets or savings on the affidavit.

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

It's the petitioner's finances that they want information on. Does his full time job earn him enough money to meet the I-134 requirements? If so, no savings or assets are needed on the form.

Do you know where i can find a list of I-134 requirements? Thank you.

Yes he does have a full time job. Also from your experience is it best to get a lawyer to help support us with our application? Thanks

Is it only the two of you in the household? if it is he will need his gross income to be a but under $20,000 per year. Unless there's something about your situation that makes it really complicated i highly doubt you'll need a lawyer. I'll try and find the link for you

That was very helpful. Thanks. Yes it is just the 2 of us. The only reason i was thinking of a lawyer was to go through all our papers before we send them off ... i just want everything to be perfect. These things can take so long from what i can see from others timelines.

Save yourself some money. You don't need a lawyer. If it's just the two of you, it's very simple.

If his salary meets the requirements (it's a bit above 18k for a two person household, I believe) then it's even easier. List his income on the I-134 and back it up with evidence such as tax returns (including W2s), pay stubs, and a letter from his employer. Then you're all set.

Just a question on that above... when you guys say "tax return", do you only mean those IRS transcripts or something more?

No we have not sent anything off yet ... we are right at the start of our journey :)

I am just very confused with all the information online just trying to digest all. So we sent off the I-129F and then when do we send the I-134? Packet three? Im a little confused, sorry.

I suggest reading the guides and taking a look at the example forms. The guide gives you an excellent breakdown of each step and what to expect. :)

In short, you will send off the I-129F petition. This is simply a petition asking for permission, basically, to file for a K1 visa. USCIS wants to make sure you are eligible and meet all the requirements. All USCIS cares about at first is that you are both free and legally able to marry. They want basic biographic information on you and your fiance and they also want proof that you've met in person in the last 2 years. That's all the first package is, really. Proof of citizenship, proof of ability to marry, and proof of relationship.

Once USCIS approves your petition, it will be first sent to NVC and then to the embassy in the beneficiary's country. Packet 3 is something the embassy sends the beneficiary, asking for some more forms. Each embassy is different, so I can't tell you exactly what will be included in the Packet 3.

After Packet 3, there will be an interview at the embassy. That is where you will provide them with some original documents such as the I-134 (and supporting evidence), police certificates, birth certificate, your passport, proof of ongoing relationship, etc.

That's a really basic breakdown of the process, but again, the guides and example forms are a lifesaver. :)

Check your regional form as well for embassy specific questions.

Yes, IRS tax transcripts are fine as well. :) Either that or copies of the tax forms that the USC sent in (1040ez and W2s, etc)

the guides here are extremely helpful! If you're still not totally sure on what to send with the I-129F then before you send it maybe post on here what you have for it and people will be able to offer suggestions or tell you what you might be missing.

If you have savings that are not held in long term CDs, annuities, etc., or that can be easily converted into cash (e.g. "liquid" assets). Then, I think that they qualify.
