Hello,

I have one question which I really do not know the answer to it. So while I was looking around through the net I found this website and I hope some members can help me out.

I'm a non-US citizen hoping to get a visa to the US. I have two small brothers, age 6 and 8, who were born in the US and are US citizens. They currently live with me in a foreign country. Will I be able to get a US visa through my two brothers? I hope they can in someway sponsor me. If it's with any help, I'm 23 years old and educated. I have graduated from an all-accredited American university. I've also co-published with a professor a scholarly article in the Advanced Financial Economics journal.

If I can't get a visa through my brothers, can I get a work permit through my qualifications? I hope there is some solution to my problem.

no, they are minors.

the minimum age to be able to file for you is 21, at least 21 or over that age. they have to live in the US and the waiting time for siblings is over 10 years or more depending on where are you from.

try to find an employer that can sponsor you.

Aleful is correct. Your brothers will be able to sponsor you when they are adults, but not yet. It sounds like you have good qualifications, so a work visa may be an option.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

work, or you can continue your studies in the US and apply for a student visa, which will then give you the option of OPT (working) after which would give you more time to establish a job where they will sponsor you for another, more permanent visa (renewable) there is also the green card lottery. You can look into that on the USCIS website. Good luck! :)

I already applied for a graduate school in the US. Still waiting for their reply.

I also don't really know how can I work in the US. How can I get a company to sponsor me? Submitting my CV online in their careers page? Most big companies (Forbes 2000) have online job portals but require you to be already in the US. In that case, should I apply for a tourist visa and try to get a job in the US during my visit?

Any suggestion would be of great help.

It's entirely up to a company whether they want to sponsor you for a visa. In general, they have to demonstrate that you have the knowledge, skill, or talent to fill their position, and that they are unable to find a qualified candidate within the United States. In other words, they have to justify bringing an alien to the US to fill their position.

There is an annual limit on the number of those work visas which are made available. The quota for the next fiscal year usually become available an April 1st. Companies that want to sponsor workers usually flood USCIS with petitions at that time. Traditionally, the available visa slots are allocated within a week or two. An employer can submit a petition after that, but it will be denied because the slots have all been allocated. If the petition is accepted and approved then the visa will usually be approved within a few months. You can't start working until the beginning of the fiscal year your visa is issued for, which is October 1st.

If there's a job you think you're well qualified for then it wouldn't hurt to contact the company and inquire about being sponsored for a work visa. You should probably contact as many companies as you think you're qualified to work at. April 1st is coming fast...
