Denied Spousal visa CR1 in Casablanca

I would appreciate any help for my situation

My spousal visa CR1 got denied in Morocco, Casablanca. How much time does the USCIS take to review the case again? I heard that it might be 6 months and other members told 2 years.

What should be done during that?

The senator got involved and he called the consulate to know the reason for the denial but the senator got no specific reason for the denial,he was told that the case was sent back to USCIS for the review. The letetr that I got says that the case was sent back under the 221 (g) law section of immigration.

I appreciate any help from the VJ members, about How much time does the USCIS take to review the case again and get another interview in the consulate and what I and my wife should do during that time?

I heard it takes 6 months till 1 year for it to get back to USCIS.

While you are waiting I think you need to figure out why it got denied. Did you interview or an american wife?

Ask yourself--

what quesions did you answer wrong, did not know?

What red flags are there?

How much older is she?

Did you marry the first visit?

How much time has she spent in Morocco with you? and your family?

Did you have enough evidence? Pics with family in person or on webcam?

Letters from Morocco family approving the marriage

Any religious differences?

Do you have daily or weekly communication with each other?

Where did you stay together in Morocco? If with family did they write letters stating that?

When you figire out what went wrong then you can start gathering ALL the evidence from the start of your relationship.

And have it organized and ready for when they do send it to uscis cause you will only have 15-30 days to respond to a NOIR/NOID.

The american can keep in contact with the senator or congressman but I do not think it will help too much.

Proof is what you need. And you need to be honest with yourself and remember why they would have denied you

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

Ok wait...I know it is on a case to case basis...but this brought up again problems of something fishy with CASA if OP was denied, CASA can just do the same type of

When two people have committed themselves to marriage, taken the time to file, wait, (even if couple applying had too many red flags) CASA does not have to give any reason for denial? and...Senator's requests for explanation?? Yes I am worried.

I am seeing this as unemotional and uninvolved as I can.....case to case .....does this really happen so often?

OP is not really divulging any real info on their case why they might have been denied and I do wish them luck, so I assume it was handled fairly.....

What does one do after a CR1 denial? Somebody? Anybody?

From what I understand Casa is Hard. I hope you front loaded your petition with proof cause it looks like they do not accept the extra proof at the interviews. But even some that have front loaded get denied.

Do not worry. Just practice answering questons to any red flags you might have.

Woman older then the man

Woman unable to have kids

Married on first visit

in person together only a few weeks-they like it when woman lives with man in morocco a couple few months

different religions

family does not approve

Only 1-2 visits to morocco

need daily contact or frequent

If you did not front load-do not worry. YOu will have a chance to send more evidence with the DS230--and I would. Cause I believe the Counselor will look at that evidence.

Do not worry. Just prepare. Have him know EVERYTHING about your family, job, kids, nephews, neices, fathers job,send him pics of where you live and what you hme looks like. Talk alot with him.

You will do fine as long as he knows everything and if you can...go to him for the interview. I do not know if they let you in but have him take your passport in with him to prove you are there.

What does one do after a CR1 denial? Somebody? Anybody?

Spousal visa petitions approved by USCIS never expire. If a spousal visa application is denied by an Embassy or Consulate and sent back to USCIS, one of the following two things will happen:

  • USCIS reaffirms the petitions and sends it back to the Embassy/Consulate for another interview
  • USCIS sends a Notice of Intent to Revoke (NOIR) to the petitioner

If the petitioner receives an NOIR, they must respond to the notice by the stated deadline rebutting the issues that are spelled out in the notice. Once USCIS receives the NOIR response, they will make a decision on the petition (reaffirm or revoke).

I may help the more experieced and knowledgable folks help youi if you say what reason was checked fore denial on the 221g letter

In general the 221g letter will not divulge too much informationa about why the petition is being sent back to USCIS...there will be a detailed cover letter sent to USCIS outlining the defects, and from that letter will evolve the letter back to the relevant parties about what evidence they will need to provide....just responding by saying "it's not true' or something equally futile will have zero effect....once the consulate sends it back, it's back until USCIS either reaffirms it or revokes it...and the embassy will not tell the congressman/senator much in the way of details either, because they are not required to do so...all they will likely say is that 'the petition appeared to be not approvable and so we have returned it to USCIS for further review..." and the congressman/senator cannot order the embassy to divulge the reasons.

Ok thank you for correcting my terminology....my then fiance was handed the 221 after his interview, which did not give any reason why he was not approved, attempted to find out why through many emails and then on 9/30/11, in the mail I received a

NOTICE OF DECISION

which does not sound like the way you describe it...IT is not coinciding with the letters... NOIR

it read in the end of the poor xeroxed copy...

citing 8CFR214.2(k)... Since the period of Validity of the petition has now expired the petition will not be re validated....all USCIS action on this petition in concluded as of the date of this notice.

Concluded. Expired. Ended. Good night Irene.

This was my point...is this allowed to happen with CR1 applications too?

As I previously stated, no; approved spousal visa petitions do not expire. When a spousal visa petition is sent back by an Embassy or Consulate, there are only two possible outcomes once it gets back to USCIS and I spelled out those outcomes in my previous post.

When a fiance(e) is sent back by an Embassy or Consulate, there is a third outcome that is in addition to the other two I spelled out and that third outcome is "the validity of the petition expires and USCIS takes no further action on it." Majority of the time, this is the outcome that most couples encounter when a K1 visa is denied and the petition is sent back.
