Hello VJ's,

I am so sad right now :(( We found out just this January 03 that the petition for divorce recognition of me and my ex had dismissed said because of insufficient evidence. What makes me upset was it was dismissed September 23, 2011 and if we are informed immediately it won't take this long :( Maybe the required documents to be submitted would be done... I hope the government sometimes do their job as it is. Now the only thing they need is the civil code authenticated from the Philippine consulate in Chicago to make my petition terminated. They are only giving us until the 18th to appeal. I am so scared because our I-129F will expire March 28 and I hope before that the decision will be submitted so that i can get record from NSO... I was so disappointed because I always follow up our case and they said no decision yet but then we found out it was dismissed 3 months ago :((.

So all I can right now is pray and I m sure my fiance is frustrated already from waiting! I wish my ex feed those Atty.s!!!

November 29, 2011 - NOA2

January 13, 2011 - Eligibility Letter Received

April 16 2012-Medical appointment-PASSED!

Why did you begin the immigration process BEFORE you completed getting your divorce recognized?

You do realize that you need to be free to marry when the petition is filed, right?

Why did you begin the immigration process BEFORE you completed getting your divorce recognized?

Bob 4 Anna is correct. You jumped the gun and filed your paperwork too soon. Even if your previous divorce becomes recognized AND you are lucky to get a counter copy of the amendment the day that you submit it to the NSO, it will still show the date the judge signed the order, which will be dated after your K-1 paperwork was originally submitted. I'm pretty sure that they will see that at your interview.

I don't see any basis in procuring an autographed copy of the Family Code from the Chicago Consulate for anyone as it is plastered all over the Internet. Notwithstanding, it would be up to the foreign Embassy to interpret and sort out country specific technicalities.

Perhaps the best advice would be for your fiancee to write the USCIS and simply withdraw the current I-129 petition. He can file again once you go through the RTC again are indeed free to marry in the Philippines, and that you have disclosed your previous work abroad and obtained your police clearance from Kuwait. Any other material omissions? Good Luck!

Ok to make it short. we didn't file the I-129F until August because the final hearing for petition of divorce recognition was done July 01. Our I-129f was approved November 28t. but i called the lawyer and asked if the divorce recognition has been recognized he said no information yet but late to know it was dismissed september 24 and that they need the authenticated civil code from chicago... the problem is they sent us letter through local mail and we didnt receive it
