Hi I am engaged to a girl in Malaysia, we are getting married in May. I have been to see her twice and am going again in about a week. However she has not yet been here to the USA to meet my family. We tried to get her over for the holidays but her visa got denied. We tried to get a "tourist" visa since we are not getting married in the U.S. Should we try a "fiance" visa instead? Can we, even though we are not doing the marriage here?

any advice would be much appreciated!

If you get a K-1 fiancee visa then you have to get married in the US, that is one of the requirements of it. If you decided to get married in another country then you will need to apply for a spouse visa after the wedding

The K-1 of 'fiancee' visa is for persons who intend on getting married in the US within 90 days of entry.

You could still get married in May but file a CR-1 instead after which would allow her to move here permanently.

If you just want a visa for her to visit you, she would need to apply for a tourist visa though.

Where do you plan to live once you are married?

A fiance visa is for a USC to bring over their fiance in order to marry them in the US. You would have to sign letters stating that you will indeed do this if you get the visa. So that option doesn't seem smart unless you do decide that getting married in the US better fits your plans.

If you plan to live in the US you can file for a spousal visa after the wedding.

Why can't she get a tourist visa? Perhaps it was something in her circumstance that might change in the future?

We can understand your pain. Two of my fiancés friends have been denied B1/B2 Visas in Malaysia. It caused us a lot of stress when we were going though the process of getting her B1/B2 Visa. We were lucky because the offices never asked her if we were dating.

If you are planning to get married in Malaysia you should not apply for a K-1 visa. The K-1 visa is for people that intend to get married in the US. You might want to try applying for the B1/B2 visa again with more evidence. When we applied we had my fiancés work contract, bank account information, letters from her employer authorizing her leave, financial statements showing that she supported her mom and dad’s income, health insurance and mortgage payments. I hope this helps you.

Thanks for the info! So its not good if they know your dating? She had a lot of documents with her, I think maybe some of the questions threw her off they asked about me and my family. But yes we will try again. Is it possible to go into embassy and talk to someone in Malaysia? Im visiting her again in 2 weeks, is there anything i can do there?

If she is denied now, and re-apply for tourist visa in short term may not give much positive sign. What reason did she mention to visit the USA?

I think she not marring USA, she will marry you. So question is does she really care where she gonna live? or it more important with who she gonna live?

I know that my fiancee does not mind live anywhere as long we together that what counts. I believe in that. My fiancee never been in US.

Once tourist visa denied it will auto-denied again. To get tourist visa she need very good ties back home and have good amount in a bank. As soon they hear "I am visiting fiance" and/or "I am single" and/or "I do not have high pay job"

I am 100% sure if you apply for tourist visa you will get denied as well it might negatively affect K-1 visa.

Are you planning live in Malaysia if she does not like US?

it's really easier (and more expensive, alas) for your family to go to KL to visit with her.

So its not good if they know your dating?

When we applied for our Visa we were under the impression that it wasn’t a good idea to tell them you are dating because the consolers job is to prove that applicant is not an immigration threat. Our thinking was that being in a relationship might raise a red flag. So we just omitted it and said that since my fiancé took me to Malaysia with friends to introduce me to her country, I was going to do the same for her. None of what we said was untrue, since I went with her and 3 other friends to Malaysia before it was just trying to present the information in the best possible way.

The other thing that we had going for us was that we applied for the Visa in Japan and not Malaysia. I think they treat people in different countries differently when applied. I say this because when my fiancé comes in on flights that have a lot of people from the Philippines she always gets pulled into secondary. When she comes in on flights that are direct from Japan they only ask her two questions.

Is it possible to go into embassy and talk to someone in Malaysia?

To be honest I do not know. In our case I did not try and in Japan you people were not allowed to go in with the person applying for the B1/B2 visa.

I do know that one of our friends was denied a “tourist” visa for his mother-in-law. They wanted to bring the mother over to the US for a month after his wife had their baby. He went into the consulate with his mother-in-law and spoke with the offices during the interview about 6 years ago. He was able to get help get the visa approved. However, I do not think this is normal based on what I read on the web KL embassy web page http://malaysia.usembassy.gov/arriving.html. I should also add that the guy I am talking about was ex-military so he might have pulled that card when he went in. I can tell you this for sure, in Japan I would not be allowed to be in the interview.

This is a good idea. It is better if she has the chance to come over here at least once. In my case she has been here 3 times and she still has a 1,000,000 questions about everything ;)

Hello Val,

The biggest question is where you will be getting married. My wife just went through this process and it wasn't that easy. She was denied for a tourist visa twice when she wanted to come visit me while the CR1 was processing, I guess the big thing would be where would you be getting married. My husband (then fiance) and I were living in Scotland and he was tired of his job so he started looking for a new one...I told him to look anywhere in the world. I'd move to deepest darkest Siberia as long as we were together. We ended up in Vermont for now :)
