J2 Visa - Can I leave the US while waitign for my EAD

Hi again,

I have another question about the EAD process.

During the waiting time for my EAD (which I will get on basis of my J2 visa)I will need to fly back to Europe for a wedding.

Is it an issue to leave the US while the EAD is under processing, as long as I am there for the interview?

Not unless you have AP. AP (form-131) is the travel documents that allow you to travel before you have a green card.

EAD is the card that lets you work - has nothing to do with travel. If you leave without AP then your application will be abandoned.

If I understood the OP's post correctly, he/she is here on a J2 as a derivative of a spouse on a J1 visa, and thus not applying for a GC.

I am not 100% sure about this, but I don't think there is an interview involved to get the EAD. The appointment is probably for biometrics - but I might be wrong about this.

In either case, you should be fine to travel with your J2 visa with or without the EAD, as long as you are in the US for the necessary appointments related to the application process. The EAD is only for work purposes and doesn't affect your ability to travel.

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

hi, just curious how this worked out?

I am planning to apply for EAD based on a J-2 as well. I was wondering if it was a problem that the I-94 (white card in passport, arrival record) is submitted during the EAD application. does that cause any trouble when leaving or re-entering the country?
