when to file form 400?

My husband is soon to be ready to apply for naturalization. I have heard 2 different things. File on the day that you have been in the usa for 3 years, or file 3 months to the day before the 3 years. Which is correct?

Married May 14, 2008

USC Received Tunisian Residance Card December 1, 2008

DCF CR1 - Tunisia Consulate

Applied I-130 on May 5, 2009

Received Packet 3 - May 30, 2009

Received Packet 4 - June 8, 2009

Final Interview - June 11, 2009

Visa Approved - June 11, 2009

Visa Printed - June 12, 2009

ENTERED USA - JUNE 24, 2009 !!!

Green card received - July 16, 2009

Social Security number - August 18, 2009

you can file up to 90 days prior the 3rd year of residency. 90 days is not always 3 months, be careful, some months have 30 days, while others 31. That's they soonest one can file.

after that, whenever you want to. two months prior, one month, whenever.

The window opens 3 years minus 90 days from being an LPR (see resident since date on his greencard). Any time after that date. Right away, 6 months later, 2 years later... whenever. As long as you've been married 3 years by the time he's approved it'll be fine.
