Affidavits proving bona fide marriage

Hi All,

We're enlisting the help of a couple of people to swear affidavits for us to the legitimacy of our marriage as we have almost no "acceptable" evidence. Does anyone know where I can get an example of such a document that we can use as a guide? I want to be sure that we carver all of the information that will be needed for it to be accepted.

Thanks!

Nit-picky but the Affidavits PROVE nothing. They are only statements attesting to knowledge of your relationship. They carry some weight but not a lot because friends and family will lie for you, and because they aren't "behind closed doors".

You need to work on other evidence as well. What about your Wills? Have you updated your Wills? Life insurance beneficiary? 401K beneficiary? Tax returns showing joint filing, receipts from sending money or gifts, cards from your wedding from family/friends.. stuff like that.

Good ideas. Thanks! Unfortunately, here we live, we don't file taxes. As of now, neither of us has a will but we can certainly do them. No major assets to speak of o there hadn't been a need. I had assumed that only "official documents" would be accepted to prove the relationship and hadn't thought of cards and receipts. I will work on some of those. I have been added to his medical insurance and we have the same post office box. sadly, we don't even have street addresses here so we can't show physical residence at the same address. We don't even have utility bills since ours are covered by the company we work for. I'm not sure if I can add a non-US person as a beneficiary to my 401k accounts since he doesn't have a social security number yet. I'll give it a shot though! All of these other ideas are good ones and I'm holding on to as many as we can get!

Thanks for the thoughts!

So you work together? That's good. You could ask your HR department for printouts showing that you both work there. Or even ask them if they can print off your direct deposit information (proving you get paid into the same account... if you do). You could get payslips showing that you get your payslips mailed to the same place, you could get bank statements showing joint accounts. You could show bank statements showing payments that you make for her (say her car payments or something) or vice versa.

You could ask for an Affidavit from the landlord where you're living or again your HR department stating you live in the same residence and they pay your bills.

As for tax returns, if you're earning income you need to file taxes in the US. There is a foreign income exception but you still need to file taxes if you earn enough that you would be required to file in the US. For the I-864 you need to provide income information. If you haven't filed taxes you need to tell USCIS why you aren't required to.

Do you file taxes in the country you're living in?

Some more ideas:

Joint bank account is excellent.

You can also provide itineraries of joint vacations you guys had together.

Perhaps a joint ownership of a car?

Wedding ring receipts also contribute to the bona-fide of your marriage.

But the best!!!! drums please... are JOINT PICTURES of both of you from different occasions (it would be even better if you had pictures of both you with your families)
