I met my fiancé while he was illegal in the USA. We then we back to Mexico together to hope we could start the whole process the 'correct' way.

Have you met your fiancé in the USA while they were illegal and in the end got approved for your visa?

Do you mean unlawfully present, or EWI? If you mean EWI then this would apply mostly to people from Central or South America. The only way my wife could have entered the US without inspection would be if she swam across the Pacific ocean.

There are a whole lot of variables here, but presuming the alien didn't get into any legal trouble in the US, and wasn't deported, then the approval rate for I-601's in CDJ is pretty good. I read an article yesterday that claimed it was 70%, but I think that was primarily for spouses. I'm not sure if the approval rate is lower for fiance's.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

What is 'EWI'? But yes I mean as in unlawfully present in the first place, never had any papers to come to the USA but did. He never was in trouble with the government and didn't get deported.

Entry Without Inspection

Basically means running/swimming accoss the US Border, or other means of entering other than a valid PoE

Your situation is the norm on that site.

Okay then in my case yes EWI. So there are many people who do this and file, how are the outcomes usually with this and a K1? We've been approved from USCIS so I'm hoping its not that bad he was there.

Dunno, and frankly I have enough on my plate with my own K-1 process. I prefer to do it the legal way, usually less issues/complications down the road.

YMMV,

What? I think everyone wants to do things in life the legal way however you can't help who you fall in love with.

I did tell them we met in the USA, I'm not too worried about it I was just wondering how many people if any have been in my situation and have had their visa approved.

But there was no record at all of him this being computer data entry of his name, no doctor visits, nothing.

Well,

I'm glad you were honest in your answer on the I-129F, but how can you NOT be worried about it?

This will DEFINITELY come up at the interview. What are your plans to answer the Consulate's questions?

*** One post removed for violation of TOS "Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method." One post quoting the removed post returned below ****

Careful of what you advise the OP. First of all, if there is ANY record of the beneficiary being here illegally (hospital records, ANY kind of traffic ticket, basically ANY computer entry showing him here - answering "no" as to whether he's EVER been here could trigger a lifetime ban for material misrepresentation.

Secondly, advising someone to be "mum" on the traveling violates the TOS of VJ. While the OP is correct when she says you can't help who you fall in love with, advising the OP to hide or deny facts either on petition or DS forms can bite them in the butt for a long time.

I do understand it will come up during the interview and he is going to tell them the exact story about coming to the states. I'm not worried because if this visa doesn't work out we are going to marry in Mexico and try to have him come over and if that in the end doesn't work out then we are just going to keep living in Mexico like we've been doing for the past 3 years. It would be nice to go back to the states however it is not a necessity and won't effect our relationship
