I had my interview yesterday at USEM.the CO didnt tell me if my visa is already approve.she just told me that they still need to see my child's CRBA.my husband is a USC.we have a daughter but she was born out of wedlock.based on the CRBA checklist,my husband needs proof of his 5 year physical presence in the US before our childs birth.my questions are:

1.can we show the CO of my husbands medical records in hawaii and his elem. class pictures?his old philippine passport was lost.we cant also get transcript from the schools he attended before because we cant contact them.

2.can my husband transmit his citizenship if we cant show them enough proof of his physical presence in the US?He is a US citizen.he was naturalized.THE CERT.OF his NATURALIZATION was lost but we have a photocopy.

How long has he been in the USA?

Good proof are things such as leases or home ownership, bills, bank records, get former employers to write letters, school sand college transcripts, taxes filed as a US resident.

hi.thank you for your reply maam.he doesnt have any property.when he was in elementary,he attended 3 schools.he only have 2007 itr.he went to u.s. on 1996.these are the following dates maam:

1996-1999 USA

sept 1999-went to philippines

2001-2005-studied in the philippines

2006-feb 2008-USA

on dec.23,2008,our child was born.

Depending on the months he arrived and left the USA, sounds like it will be very close to the 5 year mark. Can you get old tickets from when he traveled to and from the US? I don;t think class pictures will be enough- he could technically have been there for a week and have them taken- but school transcripts or a letter on official paper from the school stating he was there from X to Y date, will help.

The USEM's website (http://manila.usembassy.gov/service/citizenship/first-time-report-of-birth-abroad7.html) says he will nee to provide his original naturalisation cert AND a photocopy, so just the photocipy is not enough. Have him have anmother close look everywhere it could be- maybe parents house or somewhere? If he cannot find it, he will need to apply for a new one. It's costly to do that!

and I think it will take a year maam for him to get a new one.we can not contact the schools anymore.so what we'll we do now.im so confused.if we can not provide them more proof,what is going to happen on my visa?thank you maam.

They may delay the issuance of your visa until CRBA is completed, even if it takes a year, I don't know. I know when I went for my visa, the only real questions they had is about CRBA for my twins, they seem to put a lot of importance on it.

my agent told me that they will no longer need the cert.of naturalization.whats important is we have the number.NOTE:he misplaced the cert.he told me also that the physical presence is not important since my husband is a us citizen.according to him the embassy will require us to go on dna testing process.if the result is positive,my child will get the CRBA.is this true?thank you

Who is this "Agent" you mentioned?

They sound like a quack to me as they're basically telling you the exact opposite of what the US Embassy has already told you. Your husband will have to prove 5 years residency and provide the certificate of naturalization.

Also the US Embassy doesn't always require DNA testing especially if you have good proof that your husband was physically present when the child was conceived.
