If he married at 19 there's no way he could have worked enough as a minor (this is their dilemma). Does he have an aunt or uncle willing to cosponsor? Their income has to cover themselves as well as those in their household and your daughter in law. If not, Boiler's suggestion is valid. If the 2nd part of the picture is the issue of not seeing each other for 10 months why hasn't your son visited her?

Honestly, Canada is one of the easiest countries to obtain an American visa form. I say this after receiving my visa a few months ago. The process cost me about $3,000 without needing to get anything out of the ordinary and is going to cost me more later on when I file for my green card (since I got a fiance visa instead of a spousal visa). All spousal visa interviews are held in Montreal so she'll have to travel there to get her visa approved, so plan for travel costs, as well as the cost of the medical exam and the interview fee. Then there's plane tickets, moving belongings, etc.

Anyone in the process of obtaining a visa who wishes to cross the border must bring proof of ties- without it there's always a risk of being turned away. Something like a simple letter from an employer or a lease or paperwork documenting the immigration process is usually sufficient. Even affidavits from her parents would help out, or a return ticket if she's taking the plane. Remember that the border patrol officers are trying to prevent more illegals from entering the country and that includes Canadians, too. Many Canadians in the process of obtaining spousal visa have successfully crossed the border by bringing this documentation with them.

The poverty guideline is extremely low- if your husband makes enough he should be able to sign as a co-sponsor. If he signs as a co sponsor make sure to include copies of his tax returns and W2s along with proof of his american citizenship (a photocopy of his passport or birth certificate, for example.)

If your son hasn't worked for 3 years that's okay- he can just bring all the tax returns he's filed. The Montreal embassy usually only cares about the most recent one, anyways.

The process seems really overwhelming while you're in the midst of it, I know, but it's truly not that difficult when you're in Canada :) Venturing into other regional forums here, such as Nigeria, I become aware of just how very lucky and privileged I am to have such a relatively easy process to go through. Sure, it takes about a year and costs a couple grand, but it's a necessary formality. If your son or daughter in law are a little lost about the process I recommend you tell them about this website so they can check out the guides and post questions in the Canada forum if they need further guidance. Once you get some questions answered the process becomes a lot clearer and it's easier to relax! Where there's a will there's a way.

Edit: And yeah, Canada is a little easier to get a visa from but you still have to go through all the bureaucracy, and besides, sometimes Canadians like to travel away from their homeland in the great white north :lol:

Edit 2: Wait, did they go the K3 route? The K3 visa is pretty much a dead visa now for Canadians- it's pretty much been replaced by the IR1/CR1. It takes longer than a K1 or IR1. If unfortunately they've started on a K3 visa, they should be prepared for the process to take a little while longer and cost a little more :/ They'll still get there, though.

I'm confused, is the only hold up to the visa is the fact he does not make enough to sponsor his wife? He filed for the K-3 but did he also file for the CR-1? Or filed for both? K-3 will get his wife here, but it takes a long time and is more expensive in the long run.

It shouldn't take a year to get an interview in Montreal or Vancouver unless there is a hold up with the paperwork.

If he's a little short on the amount needed, you can co-sponsor to make up the difference.

He's only 19, so he doesn't have three years of tax returns. Montreal only really cares about how much money he is making now. Have him write a letter stating that he did not have to file tax returns because he did not have a job, or made below the exemption amount and send that with the I-864. Also have his HR department write a letter of employment stating how long he's been employed, his wage, and the year to date amount he's made. Also include pay stubs and a statement from his bank with his balance.

If you co-sponsor do the same.
