We are going to be traveling to Morocco soon and my husband has an expired visa but a conditional green card. How would you obtain a visa for a non citizen to travel back to his home country? Would he have to go through a Moroccan embassy here in the united states or could he go through any common place to get a visa?

Are you asking how he would be able to enter Morocco? Does he not have a Moroccan passport? That should be sufficient--no visa needed for a citizen to enter his own country.

then, what matters, to get back to USA, into the USA, past any POE,

is

a valid greencard.

what does he have, really?

make a list, post back in yer topic, list dates of each thing and expiration dates on each thing.

Visa.... Expired

Question is... What will he need to the back home to United States? Initially he had to have a visa to travel here to the United States when he came in the first place. But its expired now. Green Card trumps all, on all documents printed stating 'USA Something'

Visa Expired? no big deal - green card replaces it, and replaced it on issuance.

Mostly (sorry, in fact, IN TOTO)

IF he came into USA on a K-1 visa - it was invalidated the day he entered the USA.

I'll work on getting it filled out. I have it filled out (already half of it) under a different I.D.) lol... Never finished the rest after a while because I forgot the dates and didn't have them handy... But I'll work on it! Thanks a bunch for your help tonight! ;-)

I'll be interested to know this, too! I was under the impression that you also had to have the "advance parole" status. Does the need for that just go away once they issue a green card?

I'll be interested to know this, too! I was under the impression that you also had to have the "advance parole" status. Does the need for that just go away once they issue a green card?

Advanced parole is permission to leave and re enter the US during the LPR processing stage (once the greencard is applied for, but not yet issued). As Darnell said, greencard trumps all. Those with a greencard re enter the US with the greencard, nothing else is needed.

While it may seem realistic to just plop down and fill it now.... I work full time, and go to college full time.. and we have also just moved, so all my papers now are put away and are not immediately accessable. I do applogize for any inconvenience my lack on timeline has caused anyone but I do appreciate all the help I have received. Thanks everyone!!

Not to hijack this post...ok, I guess I am...but my husband would like to spend Ramadan with his family this year. We will be filing to remove conditions in a few months but I doubt the green card will yet be received before Ramadan. His 2 year green card will have barely expired by the end of Ramadan so what will he need in order to be able to get back into the US without any trouble?

Not to hijack this post...ok, I guess I am...but my husband would like to spend Ramadan with his family this year. We will be filing to remove conditions in a few months but I doubt the green card will yet be received before Ramadan. His 2 year green card will have barely expired by the end of Ramadan so what will he need in order to be able to get back into the US without any trouble?

2 yr GC PLUS the NOA1 from USCIS extending the GC when they accept the ROC should be taken with him while traveling. Just be careful that he does not get a BIO appointment while out of the US. Have someone get your mail and should the BIO letter arrive do what is needed to reschedule. Not doing so could casue your ROC to be assumed abandoned and all kinds of fun things happen. So will he be gone the entire month of Ramadan? Two months for ROC to be processed before Ramadan is unrealistic.
