MARCH 2012 VISA BULLETIN PREDICTION FOR F2A

Hi Everyone:

I am new here, and was wondering if someone can clarify something regarding my I-130 case. My wife is on an F-1 visa, and I am a permanent resident. I applied for her (I-130) right after our marriage in Aug 2009 here in US, and the priority date is Aug 30, 2009. She is currently studying under her F-1 visa at her college, and will graduate this May 2012. It seems based on the pace that our PD will become current around April or May. If it is May, and since her F-1 visa and I-20 will also expire in May, will that be an issue when we file I-485? Also, as we will go with adjustment of status, do I still have to pay any fee bill or submit affidavit of support? I haven't yet paid or submit anything since I received the approved I-130 receipt. Is there anything I need to submit? any fee perhaps?

Ah, too bad homer4all. I hope next one is the last VB that you ever will wait for. In February VB, state department clearly mentioned expected movement in coming months. It is not in this March VB. I am wondering whether this should have an impact on April VB or not.

It says for the coming monthS. So I think, April VB is still under that clause unless stated otherwise. I am expecting a 2month leap for April.

Hi, We don't know how the PD will move in the next few months. Hope it moves faster. But to be on a safer side, you must apply for F1-OPT so that you stay on some form of visa legally and safely until you file your I485. While filing your I485 also file for "advance parole" so that, for unknown reasons, if the PD retrogress after I485, you don't need to worry about stay and travel out of country.

The bottom line is that at the time of filing I485 your spouse should be on some form of legally approved VISA. If your VISA expires immediately after filing I485, you don't need to worry as the advance parole will take care of you.

I am not sure but my understanding is that IR 1 is applied if you are married to US citizen for more than Two years, and you said u just became US citizen, what I mean is that not just to be married for more that Two years, but married to a US citizen for more than Two years, so may be this is why

To me it should be IR-1. You can request the update with the NVC or you can request the proper when you arrive in the USA (Port of Entry) and present your marriage cert. Hope some others will put in some more vital information
