Hi all.....

i'm new here on visa journry and i have an issue dealing with but don't know where to turn. i hope someon here can advise me.

my fiance was arrested a few nights ago while we were hanging out with friends and family at my sister's home.

am going to be frank he is illegal here from honduras.he came here illegally because of gang issues in his country.

i am in no way condonig illegal migration. but sometimes circumstances put us in unpridictible situations. or less than favorable situations.

long story short he is in jail on an ICE hold, is there any way to save him i am currently pregant. and really don't want to not have him with us. i knew the risk i was taking so i have no excuse please don't judge me i just need positive, truthful advise.

Yes, he should be prepare to do voluntary deportation. This will now be a long and expensive process.

thank you. but pardon my ignorance, by volutary deportation you mean willingly sign a departation form?

and if yes what next? how can he be here legally because he will get a ban won't he? can't we try to fight for something like political asylum?

It's unlikely you can save him from deportation now BUT it's possible. You should go to the site Darnell suggested and also speak to an immigration attorney.

Worst case scenario he will be deported and you will need to petition for him to come back on a visa. It will take a year or more. It won't be quick, it won't be easy, and it won't be cheap.

there's not much you can do. He's deportable based on just being unlawfully in this country. Whether or not ICE will have him deported is beyond your influence, as your only chance would be to hope that they won't based on the President's executive order to focus on criminals first and foremost.

No judge will grant him VD.

He can either sign his deportation order and leave quickly, or fight this and wait for a judge to hear his case. That can take several months, which is why it cost the American Taxpayers an average of $11,500 to deport a single individual. ICE's concentration camps are as expensive as a 4-star hotel.

Once he leaves the U.S., he'll trigger a 10-year bar for unlawful presence, and another 10-year bar for deportation. Both bars are served concurrently, and the only way for him to come back is based on an I-130 petition from an immediate relative. If he doesn't have one, then that's the end of his American dream.

Good luck, sorry I don't have any great advice for you. I hope he or you has some money saved up for flights/waivers/attorneys. Not all of Honduras is bad. Most of the money I've spent since starting my husbands paperwork is for planes...

So far I haven't seen any undocumented Hondurans get out of deportation, but that doesn't mean it won't happen in the future.

thank you so much for your analysis on the situation. but if i file an I-130 for him since he incurred those bans won't that take forever, or do you think he will have a chnace giving the fact that he did commit a felon 4yrs ago?
