Will i be able to maintain my green card.If i go out of US for a period of 3 years and i come back every year.Is there something i have to do?I don't want to loose my green card.Iam trying to go to India for my studies and this program is for 3 years.I will be able to come back to US every year.Is this correct that i heard,i can maintain my green card if i come to US in every 11 month.

you will need the i131 reentry permit, it is good for 2 year outside of the US. I believe you can come back and renew it for another 2 years, I'm not 100% sure, but I believe so. you will need the reentry permit before you leave.

if not, you will loose residency after 1 year.

Even with a re-entry permit you need to prove that the US is your primary residence and that you intend to permanently return there. Merely getting a re-entry permit and/or returning once a year will not be enough if you cannot prove that this is temporary and the US is your home.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

Our son, an LPR, studies in Moscow and has been returning every 10 months (11 months is OK also) However there is more to it than that.

He also...

1. Has a Vermont drivers license

2. Has a summer job

3. Files income tax returns

4. Has a bank account and it is used year round

5. Has registered for the draft

6. Returns ASAP after classes end and documents this

7. Most important...he is enrolled in his Moscow university as a foreign student and RESIDENT of the United States.

If you represent yourself as a resident of any other country at any time you can lose your resident status in the US. Google "maintaining green card" and read the rules.

You can also still qualify for citizenship provided you document these absences as being for education and not being longer than necessary and showing that you did maintain your status. Be prepared to keep detailed records of everything
