Hi everyone,

I recently got my citizenship and I'm getting the paperwork ready to sponsor my parents ( Dad has been on H1 for a while, now both parents on EAD and waiting for their own GC through employment based).

I live in Washington DC, they are in San Antonio, Texas.

My question is, if I apply I-130 and they file 485 concurrently (chicago lockbox), then will their GC interview take place in DC or in San Antonio.

Thanks

I have no idea what you just said. If they are waiting for GC through employment, why do you fill out I-130 and I-485 for them???

They would interview where they reside.

Agree with the others though, why do you want to file when they are already on their way to their own greencard? Waste of money plsu you;d be on the hook for affidavit of support when you don;t need to be....

THnaks for responses.

sorry people, i was in a rush posting my previous message.

let me explain further.

Dad has file GC in EB3 category India ( Priority date Dec 2003), currently the PD is somewhere in August 2002, if I am correct.

In 2007, very briefly, all categories became "current", which made my dad file his I-485 (including I765, I693, G-325a, affidavit of support etc)on the basis of an approved approved I-140.

He is tired of waiting and now that I have become a US Citizen, I thought it would be much easier and faster to apply 485 for my parents than for them to wait for a few more years on employment based.

We also thought quite a bit about "Interfiling" but then just today decided against it as there is a potential for it to get delayed ( and it needs a lot more followups on our side, and since we are not going through an attorney).

So now, if we file I 130 and concurrently file I-485, then still the interview would be in San Antonio right ( where my parents reside).

Also another question that is bugging me is, do I need to file and include my W2s and assets even if my has his own job and is taking care of himself and my mom....how do I attach his pay information, and how do I make it clear to USCIS that they don't live with me and hence are not part of the household.

Thanks

if you file for them you are the sponsor,no matter where you live in the US, you have to file the i864 affidavit for each of them. petitions are filed separatly.

son one Aos for your mom and one complete AOS for your dad. so it is 2 of everything. you have to prove that they won't become a public charge, that's why you are their sponsor. now if you don't make enough to be the sole sponsor, because they are legally working in the US or one of them is, I believe you might be able to use their income as a joint sponsor. in that case, they would send you their i864.
