Wanting to marry in foreign country and then America

Hi all,

I am new to this board because I just got engaged last week! My fiance is from Israel, and we want to have the wedding in Israel but he is going to move to America after we get married. Waiting for a green card after we get married will take too long to process. Is it possible to file for a K-1 visa, do the religious wedding ceremony/reception in Israel first, then once approved for the visa, he comes to America for the legal marriage? Do you think that matters at all to Immigration? I just want to make sure we will be doing everything legally.

Is anyone doing something similar? Thanks!

04/09/2013 Called USCIS-informed by Tier 2 officer that my case was transferred to Washington D.C. on March 13

01/26/2014-Husband's Medical Exam

02/13/2014-Interview- Approved, but the consular officer did not see I-864 joint sponsor documents, and sent my husband home with the packet of all the original documents, and told him to mail it in when he gets it. My husband realized that the "missing" documents had been there all along. Husband immediately mailed it back.

02/26/2014-Consular office received "missing" documents and gave it to CO for review

03/17/2014-Visa Issued!

03/20/2014- Received Visa

03/21/2014- POE!

You do realize that the processing time difference between K-1 and CR-1 is generally 2 months or less, right?

There are a few advantages to the CR-1 Visa that makes adjustment easier for the immigrant also.

Primary difference is the greencard is ordered shortly after POE so the immigrant usually has it within 6 - 8 weeks of POE, AOS is a pain in the A-S-S...

No, the religious ceremony is recognizes as a marriage and the K-1 would not be issued if you are married.

Do the CR-1 if you two can not first do it in the US and then go back to Israel.

If you use the K-1 Fiancee visa, you MUST get married in the USA first! No exceptions to that rule I'm afraid.

Religious ceremonies especially in ISRAEL would be considered as legal marriage since you can get a marriage license. So you will not be qualified for K-1 anymore and have to do CR-1 which is a spousal visa.
