Out of status...what should i do

Hi visa family,

POE : october 23, 2011

I just sent my AOS papers toda and it will get to chicago on the 9th.

I read somewhere that 2 weeks prior your deadline (in my case january 23) i will be considered out of status :(

Can someone give me more infos about this.

And what should i do to fix everything ?

02-2007 : We Met and started Dating

03-2007 : Venancio & Heiani became offically Boyfriend&Girlfriend :P

12-2008 : Venancio's first Trip to Tahiti :)

05-2009 : Venancio' second trip to Tahiti :)

08-2009 : Heiani moved back to French Polynesia :(

01-2010 : Heiani visited Venancio for 1 week (after 5 months of long distance) :)

04-2010 : Venancio visited Heiani for 3 weeks(after 4 months of long distance) :)

05-2010 : Venancio left for Texas and Mississipi for AirGuard Training :(

11-03-2011 : Venancio accomplished his training and is back on the island :)

13-03-2011 : Venancio Welcomes Heiani for a visit of 7 weeks ( after 10 more months long distance):)

17-04-2011 : Venancio proposed to Heiani....Fiancés Status :)

30-04-2011 : Heiani goes back to tahiti...more long distance :(

03-05-2011 : Application sent

14-05-2011 : NOA1

18-07-2011 : NOA2 ..... APPROVED !!!!!!! :)

11-08-2011 : Packet left NVC for US Embassy Suva, Fiji

06-10-2011 : Interview Date : SUCCESS !!!!

23-10-2011 : POE : Honolulu Hawaii

09-11-2011 : Marriage : Mr & Mrs BERNABE <3

09-01-2012 : Application sent for AOS

You sent off your AOS paperwork before your 90 days was over. Therefore you have no overstay days. Now you will begin a NEW period of authorized stay based on pending AOS. Everything is fine!

Maybe you read that the Social Security office will not issue you a Social Security Number if you have less than 2 weeks left in your 90 days. This is true, but that's not because you are out of status. That's just their internal policy. If you miss that window for SSN there are other times you can get a number. All is well! Relax!

The K-1 Visa is dead apon entry into the united states. You married with in the 90 days of your entry you fullfilled the requirements of your visa no sweat! If you really wanted to you could wait 20 years and not file for adjustment of status and you would be fine. I came across a story of some one who did that. It would just be majorly inconvient for you but they can't kick you our for not doing so. ;)

Timeline

The thing about the 14 days before i94 expires is probably not being able to get SSN among other things. You're okay as long as you don't decide to walk around close to the boarders and waive your i-94 in the air.

I(we) filed about a month and a half after the i94 expired. I probably have to get a new driver's license again but that's about the effect it has had on me when it comes down to papers and documents. Your NOA1 extends your period of lawful stay. If you want you can carry around a copy of it to feel better but it won't have any effect when trying to get SSN or going to the license branch - most only accepts the EAD or green card depending on the state.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
